<br />._~ <br /> <br />, ,I <br />II: <br />II, <br />I' <br /> <br />~ <br /> <br />RESOLUTION No. 05-031 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVING SPOS-09. <br /> <br />WHEREAS, an application for a Special Use Permit by CU Companies for a one~day automobile <br />car sales event; and <br /> <br />WHEREAS, the procedural history of the application for a Special Use Permit is as follows: <br />1. An application was filed with the City of New Brighton on Aprill, 2005. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on Aprill9, 2005, and all persons present at the hearing were given an opportunity to be <br />heard. <br />3. The City Council considered the request on April 26, 2005. <br /> <br />NOW, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to SPOS-09: <br />1. The subject site is zoned B-4, Downtown Business. <br />2. The entire development area is roughly 10 acres in size and the commercial component is <br />roughly 7 acres in size. <br />3. The applicant is proposing a one-day auto sales event on Lots 1 and 2, Block 1 of Main <br />Street Village addition to New Brighton (500, 550 Main Street). <br />4. Automobile sales uses are required to obtain a Special Use Permit. <br />5. As specified in Section 8-130 ofthe New Brighton Zoning Ordinance, no special use shall <br />be recommended by the Planning Commission unless such shall find: <br />a) That the establishment, maintenance, or operations of the special use will <br />not be detrimental to or endanger the public health, safety, morals, comfort of general <br />public. <br />b) That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor substantially <br />diminish and impair property values within the neighborhood. <br />c) That the establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for uses permitted in <br />the district. <br /> <br />d) That adequate utilities, access roads, drainage and/or necessary facilities <br />have been or are being provided. <br />e) That the special use shall, in all other respects, conform to the applicable <br />regulations of the district in which it is located. <br />S. The Planning Commission held a public hearing, reviewed the project and found the <br />above criteria to be satisfied and recommended approval to the City Council. <br />6. The Council finds the special use permit standards to be met. <br /> <br />BE IT FURTHER RESOLVED, the City Council approves SP05-09, subject to the following <br />conditions: <br />1. The event shall be held for one day only on May 21,2005, <br />2. For Sale vehicles shall not be delivered to the site no earlier than 5:00 PM and no <br />later than 10:00 PM on Friday May 20, 2005. <br />3. For Sale vehicles shall be off site by no later than 6:00 PM on May 21 st. <br />4. An application for a Temporary sign is reviewed and approved by the City Planner. <br />5.
