._~ , ,I II: II, I' ~ RESOLUTION No. 05-031 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT APPROVING SPOS-09. WHEREAS, an application for a Special Use Permit by CU Companies for a one~day automobile car sales event; and WHEREAS, the procedural history of the application for a Special Use Permit is as follows: 1. An application was filed with the City of New Brighton on Aprill, 2005. 2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on Aprill9, 2005, and all persons present at the hearing were given an opportunity to be heard. 3. The City Council considered the request on April 26, 2005. NOW, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to SPOS-09: 1. The subject site is zoned B-4, Downtown Business. 2. The entire development area is roughly 10 acres in size and the commercial component is roughly 7 acres in size. 3. The applicant is proposing a one-day auto sales event on Lots 1 and 2, Block 1 of Main Street Village addition to New Brighton (500, 550 Main Street). 4. Automobile sales uses are required to obtain a Special Use Permit. 5. As specified in Section 8-130 ofthe New Brighton Zoning Ordinance, no special use shall be recommended by the Planning Commission unless such shall find: a) That the establishment, maintenance, or operations of the special use will not be detrimental to or endanger the public health, safety, morals, comfort of general public. b) That the special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood. c) That the establishment of the special use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district. d) That adequate utilities, access roads, drainage and/or necessary facilities have been or are being provided. e) That the special use shall, in all other respects, conform to the applicable regulations of the district in which it is located. S. The Planning Commission held a public hearing, reviewed the project and found the above criteria to be satisfied and recommended approval to the City Council. 6. The Council finds the special use permit standards to be met. BE IT FURTHER RESOLVED, the City Council approves SP05-09, subject to the following conditions: 1. The event shall be held for one day only on May 21,2005, 2. For Sale vehicles shall not be delivered to the site no earlier than 5:00 PM and no later than 10:00 PM on Friday May 20, 2005. 3. For Sale vehicles shall be off site by no later than 6:00 PM on May 21 st. 4. An application for a Temporary sign is reviewed and approved by the City Planner. 5. The Director of Public Safety shall review and approve of the proposal; and any traffic safety measures deemed necessary by the Director shall be implemented.
