' <br /> <br />~ <br /> <br />'" <br /> <br />: i <br />, I <br /> <br />RESOLUTION No. 05-024 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />,- <br /> <br />i; <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SP05~05. <br /> <br />WHEREAS, an application for a special use pennit has been made by Mr. Brian Carey to <br />construct a I 22-unit senior cooperative housing development on Old Highway 8 NW. Per <br />Section 6-560 (2) of the New Brighton Zoning Ordinance, buildings in the MX, Mixed Use <br />zoning district which are over 40 feet in height are required to have a special use pennit; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a special use permit was filed with the City of New Brighton on <br />February 25, 2005_ <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on March 15,2005, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The Planning Commission voted to recommend approval for the Special Use Pennit. <br />4. The City Council considered the request at the March 22, 2005 meeting. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact <br />in respect to SPOS-05: <br /> <br />< ! <br /> <br />, 1. The subject site is zoned MX, Mixed Use. <br />2. Buildings with proposed heights greater than 40 feet are required to obtain a <br />Special Use Permit and meet the standards found in Section 6.550: <br />a. All buildings that are located on sites adjacent to Long Lake Regional Park <br />shall take advantage of the views to Long Lake and shall provide site <br />improvements that compliment the natural features of Long Lake Regional <br />Park. <br />b. All developments shall provide pedestrian linkages to Long Lake Regional <br />Park and neighboring developments for residents, employees, and shoppers, <br />and provide integrated parking and transit elements whenever practical. <br />c. All uses shall be complementary or integrated and buildings shall be related <br />or connected in accordance with the vision of the adopted Highway 8 <br />Corridor Study. <br />d. All buildings and building sites shall be designed to encourage social <br />interchange and a sense of community, provide sufficient residential <br />amenities, and mitigate any adverse impacts of business and industrial uses <br />on residential uses. <br /> <br />3. The Council finds that the standards in Section 6-550 are met. <br />4. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special <br />use shall be recommended by the Planning Commission unless such shall fmd: <br />a) That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general <br />public. <br /> <br />I :\COUNCIL \RESOLUTIONS\2005\Com Dev\SP05-05 _APPLEWOOD POINTE.doc <br />
