<br />,E <br /> <br />-:. <br /> <br />; i <br />i I <br /> <br />RESOLUTION No. 05-016 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />~SOLUTION MAKING FINDINGS OF FACT AND ApPROVING LP04-07 <br /> <br />WHEREAS) an application has been made by the MWF Properties to be considered for site plan <br />, review for a new 52-unit building at 219 Old Highway 8 SW. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br /> 3. <br />i <br />, <br />; <br /> 4. <br /> 5. <br />! <br /> 6. <br /> <br />L An application for a site plan review for a 52-unit apartment development was filed <br />with the City of New Brighton on December 2, 2004. <br /> <br />2. The Planning Commission considered the application on January 18) 2005 and <br />tabled consideration of the application pending receipt and review of a Type 4 <br />Non-confonning Use permit to address concerns on the existing 219 Old Highway <br />8 SW site. <br /> <br />MWF Properties submitted a site plan and Type 4 Non-confonning Use pennit; the <br />Planning Commission held a public hearing and recommended conditional <br />approval to the Council <br /> <br />On February 15, 2005, the Planning Commission re-considered the site plan. <br /> <br />The Planning Commission considered the lot split and preliminary plat and <br />recommended that the Council approve the application PL04-04. <br /> <br />On February 22,2005, the Council considered the site plan. <br /> <br />'I <br /> <br />NOW THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application <br />LP04-07 is hereby approved subject to the following conditions: <br /> <br /> <br />1. Compliance with PL04-04. <br />2. A letter of credit or a performance bond is submitted covering the costs of all site <br />improvements. <br />3. Approval of a permit by the Rice Creek Watershed District. <br />4. The applicant shall provide the City with copies of approved PCA stonn water <br />pennits prior to issuance of a Building Permit. <br />5. Approval of a Permit from the Ramsey County Department of Transportation for <br />the proposed new curb cuts on Old Highway 8. <br />6. A trail easement shall be drafted on a re-submitted site plan. <br />7. A final plat review is applied for and approved by the City Council. <br />8. A comprehensive sign plan is approved by the City Planner. <br />9. Site elevations are re-submitted and shall contain all material data information to <br />be approved by the City Planner. <br />10. Landscape plans are revised and re-submitted, subject to review and approval of <br />the City Forester. <br />11. Hydrant location is reviewed and approved by the Fire Marshal. <br />12.
