DECOSTER AND MARIA D. <br />FERGUSON AS TRUSTEES OF THE REVOCABLE LIVING TRUST OF <br />DOUGLAS M. DECOSTER DATED AUGUST 23, 1999, AND ANNE S. <br />DECOSTER AS TRUSTEE OF THE STEVEN C. DECOSTER FAMILY <br />TRUST FOR THE REAL PROPERTY LOCATED AT 1823 OLD HIGHWAY 8 <br />NW, NEW BRIGHTON, MINNESOTA <br /> <br />Il. BE IT RESOLVED by the City Council (the "Council") of the City of New Brighton, <br />IlVlinnesota (the "City") as follows: <br />I' <br />'I <br />Ii <br /> <br />Section 1. <br /> <br />Recitals. <br /> <br />i <br />" <br />I' <br />I) <br />Ii 1.01 The Council previously found that relocation of Beisswenger's New Brighton <br />jiHardware, Inc. from its current site at 1360 Old Highway 8 NW to a new site to be acquired <br />ilbY the City comprised of the parcels at 1823, 1853, 1873 and a portion of 1951 Old <br />I:Highway 8 promotes the objectives outlined in the City's Restated Development Program <br />i!established pursuant to Minnesota Statutes, Sections 469.124 to 469.134, as amended. <br />';j <br />, <br /> <br />.. 1.02 The City has presented to Jean T. Decoster and Maria D. Ferguson as <br />:!Trustees of the Revocable living Trust of Douglas M. Decoster dated August 23, 1999 <br />;iand Anne S. Decoster as Trustee of the Steven C. Decoster Family Trust a purchase <br />i!agreement (the "Purchase Agreement"), attached as Schedule A, outlining the terms and <br />!IConditions under which the City is willing to purchase the real property located at 1823 Old <br />iiHighway 8, New Brighton, Minnesota, PIN #16-30-23-33-0006 (the "Property"). <br /> <br />; ~ <br />II <br />'j <br /> <br />Section 2. Findings. <br /> <br />2.01 The Council hereby finds that acquisition of the Property promotes the <br />:,objectives of the Modified Development Program. <br /> <br />2.02 The Council hereby finds that the Property is located in Tax Increment <br />: Financing District No. 30 created pursuant to Minnesota Statutes, Sections 469.174 <br />
