'.1 <br /> " . <br /> ! <br /> I <br /> I <br /> RESOLUTION NO 2227 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAr~S EY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> FOR NON-CONFORMING USE PERMIT, NC-41 <br /> WHEREAS, an application for a non-conforming use permit <br /> entitled NC-41 has been made by Northwestern Bell to permit <br /> the construction of a metal storage building on a site with <br /> Type IV non-conformities. <br /> WHEREAS, the procedural history of the application is as <br /> follows: <br /> I l. That an application for non-conforming use permit <br /> was filed with the City of New Brighton on June 13, <br /> 1979. <br /> 2 . That such application was reviewed by the New Brighton <br /> t Planning Commission Board of Review on June 19, 1979. <br /> I' <br /> I 3. That the City Council, pursuant to published and mailed <br /> notices, held a public hearing on July 10, 1979, all <br /> person's present at the hearing were given an <br /> opportunity to be heard. <br /> I 4. The written comments and analysis of the City staff, <br /> the Planning Commission minutes and recommendations <br /> I were considered. <br /> NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br /> Council makes the following Findings of Fact in respect to <br /> NC-41: <br /> l. That the site is located in a 1-2, Heavy Industrial <br /> : District. <br /> 2. That the following Type IV non-conformities exist on <br /> I the property: <br /> a. Side street yard parking in an industrial di stri ct. <br /> I b. Standard concrete block as the exterior wall <br /> treatment on a street side of the building. <br /> 3. That the applicant has done everything practical to <br /> eliminate and reduce the existing non-conformities. <br /> BE IT FURTHER RESOLVED, that the application for NC-41 is <br /> hereby approved subject to the following conditions: <br /> l. That the applicant install slats in the existing <br /> chain link fence along the southwestern boundary <br /> II of the property to provide better screening of <br /> outside storage. <br /> , <br /> I <br /> i <br /> I <br />
