<br /> ., . <br /> ""~ <br /> 1 '\i <br /> RESOLUTION NO. 2215 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> FOR VARIANCE APPLICATION VN-205. <br /> WHEREAS, an application for a Variance entitled VN-205 <br /> has been made by Getty Refining and Marketing Company to permit <br /> the installation of two ( 2 ) ground signs, 46 square feet in <br /> area in a B-1, Limited Business District. <br /> I WHEREAS, the procedural history of the application is as <br /> follows: <br /> l. That an application for a Variance, VN-205 was filed <br /> with the City of New Brighton on May 7, 1979. <br /> 2. That such application was reviewed by the New Brighton <br /> Planning Commission Board of Reivew on May 15, 1979. <br /> I 3. That the City Council, pursuant to published and <br /> mailed notices, held a public hearing on June 12, <br /> I 1979, all person.s present at the hearing were given <br /> an opportunity to be heard. <br /> 4. The written comments and analysis of the City staff, <br /> the Planning Commission minutes and recommendations <br /> were considered. <br /> NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br /> I Council makes the following Findings of Fact in respect to <br /> I VN-205. <br /> I l. That the general purpose of the sign ordinance is to <br /> promote sound identification, reduction of clutter and <br /> I aesthetic enhancement. <br /> 2. That the two proposed ground signs would meet all code <br /> I requirements except area. <br /> Ii 3. That the proposed ground signs are compatiable with <br /> surrounding properties and provide sound identificatio . <br /> 4. That the practical difficulty is that the company.s <br /> standard sign is 46 square feet and the unnecessary <br /> hardship is that the applicant would be required to <br /> have to get a custom made sign to meet ordinance <br /> regulations. <br /> 5. That the property is located in a B-1 zone and the <br /> proposed Comprehensive Plan designates the area for <br /> General Business and if the parcel was in a B-3 zone <br /> the variance would not be needed. <br /> BE IT FURTHER RESOLVED, that the application VN-205 is <br /> hereby approved subject to the following conditions: <br /> 1 <br /> l. That the ground signs contain tenant name and/or logo <br /> only; <br /> 2 . That such ground signs shall not exceed 46 square feet <br /> in area nor 20 feet in height, and shall have a <br /> minimum setback of 10 feet from County Road E and <br /> Silver Lake Road. <br /> 3. That the northern driveway along Sivler Lake Road be <br /> closed and landscaped accordingly. <br /> I <br /> I <br />
