<br />~ . .. . ~ .. <br /> RESOLUTION NO. 7L/5 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> VILLAGE OF NEW BRIGHTON <br />RESOLUTION AUTHORIZING AND DIRECTING MANAGER AND ATTORNEY TO <br />EFFECT SETTLEMENT OF APPEAL FROM COMMISSIONERS AWARD IN <br />CONDEMNATION PROCEEDING FOR ACQUISITION OF PIKE LAKE PARK SITE. <br /> WHEREAS, the Village of New Brighton commenced a proceeding <br />in eminent domain to acquire the Pike Lake Park Site and in <br />such proceeding the Court appointed commissioners filed an <br />award in the amount of $35,000.00, plus $150.00 in appraisal <br />fees; and, <br /> WHEREAS, the owner and respondent in such proceeding <br />has perfected an appeal from such award demanding trial by <br />jury in the Ramsey County D~trict Court claiming damages <br />in the sum of $50,000.00; and <br /> WHEREAS, the Village of New Brighton received two inde- <br />pendent appraisals of such land--one in the amount of $34,900.00 <br />and one in the amount of $40,000.00--and, <br /> WHEREAS, the owner and respondent has made a written <br />offer to settle such appeal fur the total sum of $40,000.00, <br />including interest, appraisal fees and costs, <br /> NOW THEREFORE BE IT RESOLVED, that the Village Manager <br />and Village Attorney be authorized and directed to take all <br />necessary steps and execute all necessary documents to effect <br />the settlement of such condemnation appeal for the total sum <br />of $40,000.00 including interest, appraisal fees and costs. <br />Adopted this 28th day of October, 1969. <br /> Lfl~ <br /> Mayor <br />ATTEST: <br />~,Q <br />V~ age &~ ~ <br />(SEAL) <br />
