U <br /> VILIAGE OF NEW BRIGHTON <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION AUTHORIZING VILIAGE ATTORNEY TO COMMENCE CONDEMNATION <br /> PROCEEDINGS FOR EASE:MENT FOR STINSON BOULEVARD <br /> WHEREAS, it is necessary, advisable and in the public interest <br /> that the Village of New Brighton make certain public <br /> improvements consisting of public street, and <br /> WHEREAS, in order to accomplish such purpose it is necessary <br /> to acquire the following described easement: <br /> A permanent highway easement over the West 33 feet <br /> of the SW 1/2 of the SW 1/4 of SW 1/4 (ex. East 400') <br /> Sec. 30, T 30N, R 23 W, containing 0.47 acres; <br /> and <br /> A temporary construction easement for the purpose of <br /> constructing slopes and backslopes over a strip 17 <br /> feet in width adjacent to and easterly of: <br /> The West 33 feet of the SW 1/4 of the SW 1/4 of SW 1/4 <br /> (ex. east 400'), Sec. 30, T. 30N, R. 23W, to expire <br /> September 1, 1970, and <br /> WHEREAS, the Village is advised and believes that the most <br /> feasible location for such public street is on the <br /> land above-described: <br /> NOW THEREFORE BE IT RESOLVED that the Village of New Brighton <br /> proceed to procure said real estate by negotiation, and if <br /> that fails, then under its right of eminent domain and that <br /> the Village Attorney be and hereby is directed to file the <br /> necessary petition therefor and to prosecute such action to <br /> a successful conclusion or until it is abandoned, dismissed <br /> or terminated by the Village or by the court; that the Village <br /> Attorney, the Mayor and the Clerk do all things necessary to <br /> be done in the commencement, prosecution successful termination <br /> of such action. <br />
