AND AUTHORIZING AND DIRECTING MAYOR AND MANAGER TO EXECUTE <br />, , ,~ <br />ON BEHALF OF' VILLAGE OF NEW BRlGHTON" <br /> <br />''''" <br />. , <br /> <br /> <br /> <br />WHEREAS the Village of New Brighton commenced an action in <br />eminent domain, entitled village of New Brighton vs. Minnesota <br />Transfer Railway Company,et al for acquisition of easements for <br />~ sanitary sewer interceptor, and included in such proceeding was <br />parcel No. 84. owned by Fred Beisswenger, Julie Beisswenger and <br />Rose Johnson, and <br /> <br />WHEREAS following the making and filing of an award for <br />Parcel No. 84 in the amount of $5,700.00 the owners appealed <br />demanding $29,000 for Parcel No. 84, and <br /> <br />WHEREAS'a proposed settlement has been negotiated subject to <br />ap?roval of the Village Council of New Brighton, which settlement <br />, ' <br />stipulation is attached hereto as Exhibit A. <br /> <br />NOW THEREFORE BE IT RESOLVED That the stipulation for <br />settlement attached hereto as Exhibit.A.is hereby approved and <br />. ,the Mayor and Manager are hereby authorized and direeted to <br />execute said stipulation on behalf of the Village of New Brighton, <br />and the village 1\t:tor~ey; Clerk-Trea's;l\J:~rare directed to do all <br />things onbehalf.q,f":; tne~, Vi,11age of; Ne~ Brighton to carry out the <br />terms of such stipulation.
