L <br /> ..... <br /> If .- '" <br /> ~ <br /> RESOLUTION NO. 1140 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> VILLAGE OF NEW BRIGHTON <br /> RESOLUTION ABANDONING IMPROVEMENT NO. 72-10, ORDERING DISMISSAL OF <br /> CONDEMNATION PROCEEDINGS TO ACQUIRE EASEMENTS THEREFORE AND <br /> ORDERING DELETION OF SUCH IMPROVEMENT FROM CONSTRUCTION CONTRACT <br /> PREVIOUSLY AWARDED TO BARBA ROSSA AND SONS <br /> WHEREAS the Village Council did by Resolution No. 1041 <br /> order Improvement No. 72-10 and by subsequent resolutions order <br /> condemnation of easements required for such improvement and did <br /> award a contract to Barbarossa and Sons for the construction <br /> thereof, and <br /> WHEREAS all the owners of the property to be served and <br /> benefited by such improvement have objected to the improvement as <br /> ordered, and <br /> WHEREAS the costs of such improvement may exceed the benefits <br /> to the lands to be served and benefited thereby <br /> NOW THEREFORE BE IT RESOLVED: <br /> 1. That Improvement No. 72-10 be and the same is hereby <br /> abandoned. <br /> 2. That the"Village Attorney is hereby au thorized and <br /> directed to dismiss all condemnqtion proceedings to <br /> acquire easements necessary for improvement No. 72-10. <br /> 3. That the portion o.f the construction contract previously <br /> awarded to Barbarossa and Sons which relates to <br /> Improvement No. 72-10 be deleted from such contract, and <br /> the Mayor and Manager are hereby authorized and directed <br /> to execute such change order as is necessary to accomplish <br /> this purpose. <br /> Adopted this lOth day of October, 1972. <br /> ATTEST: OF NEW BRIGHTON <br /> ~€~~ - <br /> Vernon <br /> (SEAL) <br />
