<br /> ;.;t \ -~ .' - <br /> .... <br /> .- <br /> I <br /> ... <br /> RESOLUTION NO. 1139 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> VILLAGE OF NEW BRIGHTON <br /> RESOLUTION APPROVING CONCEPT OF SURFACE WATER DRAINAGE PLAN FOR <br /> NORTHWEST QUADRANT OF SILVER LAKE ROAD AND 1694, AND IMPOSING <br /> CONDITIONS PRECEDENT TO IMPLEMENTATION OF ANY CONSTRUCTION UNDER <br /> SUCH PLAN <br /> WHEREAS Darrel Farr, owner of lands in New Brighton and <br /> Fridley lying in the Northweet Quadrant of Silver Lake Road and <br /> 1694 in Section 19, Township 30N, Range 23W, Ramsey County, and <br /> part of Section 24, Township 30N, Range 24W, Anoka County, has <br /> filed with the Village of New Srighton a plan for municipal storm <br /> water drainage, and <br /> WHEREAS such plan provides for drainage of surface waters <br /> from lands outside the Village of New Brighton through a storm <br /> sewer system contemplated by such plan to be constructed within <br /> New Brighton and no part of the cost of the New Brighton portion <br /> of such system can legally be assessed against lands lying outside <br /> New Brighton, and <br /> WHEREAS the proposal that Darrel Farr will provide the land <br /> for and construct at its expense a storm water holding pond <br /> within New Brighton as an integral part of such storm sewer <br /> system without which such system will be inoperative, <br /> NOW THEREFORE BE IT RESOLVED: <br /> 1. The plan for storm water drainage of lands located in <br /> part of Section 19, Tow.nship 30N, Range 23w in the Village of <br /> New Brighton; Ramsey County, and part of Section 24, Township 30N, <br /> Range 24W in the City of Fridley, County of Anoka, prepared by <br /> Darrel Farr and filed with the Village of New Brighton, together <br /> with an addendum thereto, is hereby approved in concept subject <br /> to the following conditions: <br /> a. No discharge of storm water from the part of the system <br /> to be constructed in Fridley shall be drained into or <br /> accepted by the Village of New Brighton until a joint <br /> powers agreement has been enterecl into by New Brighton <br /> and Fridley providing for construction financing and <br /> assessing of the cost of the entire system. <br /> b. No construction contract shall be let by Fridley or <br /> New Brighton for the construction of such storm water <br /> system unless and until Darrel Farr dedicates by <br /> appropriate conveyance a specific parcel of land for a <br /> storm water storage pond, provides suitable plans and <br /> specifications for construction of such pond acceptable <br /> to Fridley and New Brighton and provides to New Brighton <br /> a cash or surety bond in an amount one and one-half timeB <br /> the estimated cost of constructing such pond guaranteeinq <br /> its construction and completion. <br />
