<br />RESOLUTION ADOPTING LAND USE AND CONTROL MEASURES IN'FLOOD PLAIN
<br />AREAS
<br />
<br />WHEREAS the . City of New Brighton had adopted, and is enforcin';)',
<br />the State Buildi~g COde and the New Brighton Building Code and
<br />the, New Brighton Zoning Code" and
<br />
<br />WHEREAS Section 402:00 of the New Brighton Building Code. a.~
<br />arloptedbyNewBrighton prohibits any person, fIrm or corporation
<br />tr()m,erecting, constructing, enlarging, altering; repairing,
<br />'i1npr.oving,moving or demolishing any building brstructure without
<br />first oht::aining a sepaJ:'ate building permit for each building or
<br />structure from the Building Inspecto r, and
<br />
<br />WHEREAS the New:Brighton Building Inspector mus't examine
<br />all plans andspe:cifications for the proposed, construction when
<br />applicatioI;\., is '. made to the Building Inspector for a building
<br />, 'permit
<br />
<br />NOW THEREFORE, BE IT RESOLVED by the Council of the City of
<br />New Brightdn,~s follows:
<br />
<br />1) That.the Bv.i1ding Inspector for the City of New Brighton
<br />when reviewing appliaationsfor building permits, including the
<br />plans.and sp~cifications for the proposed,construction"will
<br />review'a.11'building permit applications to determine if the pro-
<br />posed construction is consistent with the n,eed to min.imize flood
<br />damage: '

<br />2) That the New Brighton Building Inspector shall review al.~
<br />building permit applications to determine if the site of the pro-
<br />posed construction is .re~~onably safe from flooding and to make
<br />, ,
<br />, 'recommendations for construction in all locations which have flood
<br />hazards;
<br />
<br />3) That the New Brighton Building Inspector in reviewing aL~
<br />applications for construction in flood hazard locations within the
<br />City of New Brighton shall require that any such proposed construci:iOl
