<br />'r <br />... <br />/' <br />, <br />- 11 RESOLUTION NO .2149 ,,/ ~ ~ <br /> STATE OF MINNESOTA <br /> RAMSEY COUNTY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND iREc:o..Mr,1EfJDING APPROVAL OF <br /> NONCONFORMING USE PERMIT NC-36. <br /> WHEREAS, an application for a non-conforming use permit <br /> NC-36 has been made by Northwestern Bell, 100 9th Avenue S.W, <br /> to permit the construction of a building addition~ and <br /> WHEREAS, the procedural history of the application is as <br /> follows: <br /> 1. That an application for a non-conforming use permit <br /> NC-36 was filed with the City on December l3, 1978. <br /> 2. That the Board of Review heard and reviewed the <br /> application at its meeting on December 19, 1978. <br /> 3. That the City Council, pursuant to published and <br /> mailed notices, held a public hearing on December 27, <br /> 1978~ all person's present at the hearing were <br /> given an opportunity to be heard. <br /> 4. The written comments and analysis of the City Staff <br /> and the Planning Commission minutes and recommendation <br /> were considered. <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City <br /> of New Brighton that the following Findings of Fact are made <br /> in respect to NC-36. <br /> 1. That the property is zoned I-2, Heavy Industrial. <br /> 2. Tha t the following Type IV non-conformities have <br /> been identified on the property: <br /> a. Off-street parking lot in an industrial district <br /> in a front and side yard bordering upon a public <br /> street. (Section l2-030,c.) <br /> b. Exterior treatment on the street side of the <br /> structure is standard concrete block (Section <br /> 10-130,1.) <br /> c. Lack of screening of outside storage of materials <br /> or goods fromsight of public traveling on the <br /> public right-of-way. (Section l2-060,a.) <br /> d. Driveways without concrete curbing. (Section 12-060 a) <br /> 3. The site and landscape plans submitted indicate that <br /> the following improvements would be made: <br /> a. That all driveways will have concrete curbing. <br /> b. That front yard parking spaces will be removed. <br /> c. That the outside storage area will be screened <br /> in accordance with the zoning code. <br /> d. That the wall facing Old Highway #8 constructed <br /> of standard concrete block remain painted. <br /> 4. That the improvements are substantial and meet the <br /> intent of the non-conforming use ordinance. <br />
