<br />.. <br />- ~ .. <br /> .. <br />.-~ -.' <br />" RESOLUTION NO. 2077 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL <br /> OF NC-32. <br /> WHEREAS, an application for a non-conforming use permit <br /> NC-32 has been made by Paul Williams and Northwestern Bell, <br /> to permit an expansion to a building located on property <br /> having existing Type IV non~conformities, and <br /> WHEREAS, the procedural history of the application is <br /> as follows: <br /> 1. That an application for a non-conforming use permit <br /> NC-32 was filed with the City on July 11, 1978. <br /> 2. That the Board of Review heard and reviewed the <br /> application at its meeting on July 3l, 1978 . <br /> 3. That the City Council pursuant to published and <br /> mailed notices, held a public hearing on August 8, <br /> 1978, to consider the application. All persons <br /> present at the public hearing were given an <br /> opportunity to be heard. <br /> 4. The written comments and analysis of the City <br /> Planner, the Planning Commission minutes and <br /> recommendation, and all persons statements made <br /> at the public hearing were considered. <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City <br /> of New Brighton following Findings of Fact are made in respect <br /> to NC-32. <br /> 1. That the property is currently zoned R-1 and B-1. <br /> 2. That the following Type IV non-conformities ex is t <br /> on the property: <br /> a. Lack of concrete curbing adjacent to <br /> parking areas. <br /> b. parking spaces less than the required size. <br /> c. Insufficient amount of parking spaces. <br /> d. Lack of sufficient screening along north <br /> property line. <br /> e. Existing structure is setback less than <br /> 50 ft. from R-l zoned property. <br /> 3. That in respect to the Type IV non-conformities the <br /> following improvements will be made: <br /> a. All curbing will be provided. <br /> b. Screening as required will be provided along <br /> the north property line. <br /> c. All parking spaces will be the required size. <br /> 4. That the property use lessens the need for <br /> additional parking. <br />
