STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON ORDINANCE NO. 766 AN ORDINANCE RELATING TO CRIMINAL HISTORY BACKGROUND CHECKS ON APPLICANTS FOR EMPLOYMENT AND LICENSES; ADDING ARTICLE 6, SECTIONS 23-70 — 23-72 THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS that Article 6, s 23-70 — 23-72 are added to the City Code of Ordinances as follows: Article 6. Criminal History Background Sec. R3-70. Investigation. The ew Brighton Public Safety Department is authorized to conduct a criminal history backE round investigation on applicants for employment and licenses with the City. This section applies only to applicants who are finalists for paid or volunteer positions or who are applicants for (1ty licenses. Before the investigation is undertaken, the applicant must provide written authi 'nation to the Public Safety Department to conduct the investigation and to release the info�ation to the City Council, City Manager and other City staff as appropriate. Sec. 03-71. Denial of Employment or License. to the exceptions in Minnesota Statutes, section 364.09, the City may deny an applicant's for employment or a license solely or in part due to a prior conviction of a crime or if the crime or crimes directly relates to the position of employment sought or the ion for which the license is sought. Sec. A3-72. Notice to Applicant. If tl+City rejects an applicant's request for employment or a license due solely or in part to a prio !conviction of a crime, the City Manager will notify the applicant in writing of the (1) toe grounds and reasons for the denial or disqualification; (2)e applicable complaint and grievance procedure as set forth in Minnesota Statutes, section 364. , (3)�Ii e earliest date the applicant may reapply for a position of public employment or a license; and (4) tat all competent evidence of rehabilitation presented will be considered upon reapplication.
