ORDINANCE NO. <br />769 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />AN ORDINANCE ADDING <br />NEW ARTICLE 7 TO CHAPTER 5 <br />OF THE ZONING CODE CREATING THE <br />PALMER DRIVE OVERLAY AREA <br />CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS that the New <br />ton Code of Ordinances is amended by adding new Article 7 to Chapter 5 of the <br />tg Code as follows: <br />Article 7. Palmer Drive Overlay Area <br />5-610. Purpose and Intent. <br />area located at 1101 — 1151 Silver Lake Road was redeveloped in late 2007 and early <br />8 through a Planned Unit Development. The City recognizes this site, currently <br />wn as Brighton Village, together with nearby properties, as a redevelopment area. <br />Cher, the City recognizes the need for in -fill development in this area and has <br />±rmined that it is in the public interest to accommodate in -fill development that is <br />sistent with the development parameters approved with the Brighton Village Planned <br />t Development. <br />City wishes to accomplish these goals through establishment of an overlay area. <br />will allow the City to specify the properties that may take advantage of such overlay <br />lards without undermining the intent of the existing zoning regulations. A property <br />within this overlay area may choose whether or not to take advantage of this <br />:le, as the underlying zoning will remain in full force and effect. <br />intent of the Council in establishing this overlay area is to allow variations from the <br />xlying zoning standards through the Site Plan procedures of Section 8-010 and <br />:ial Use procedures of Sections 8-110 through 8-130 when such variations are <br />istent with variations approved through the Brighton Village Planned Unit <br />5-620. Designation of the Palmer Drive Overlay Area. <br />following properties are included within the Palmer Drive Overlay Area: <br />LAny property with a zoning designation of B-3, General Business and abutting <br />liton Village at 1101 — 1151 Silver Lake Road. <br />
