<br />i' <br />I <br />"..,..-1 t .. <br />,/ I- <br />I: <br /> <br />RESOLUTION NO. 02-013 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />. RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF GP 02-001, <br />LP 01-014 and RZ 01-005. <br /> <br />WHEREAS, an application for a special use permit has been made by the City of New Brighton to rezone <br />seven parcels, approve a site plan for a new Public Safety Facility, and to approve a general <br />development plan for the site. <br /> <br />: WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a re-zoning, site plan and general development plan was filed with the City <br />of New Brighton on December 21, 2001. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />January 15,2002, and all persons present at the hearing were given an opportunity to be heard. <br />The Planning Commission considered the plans and unanimously recommended approval <br />subject to conditions (Vote: 6-0) <br /> <br />3. The City Council considered the Planning Commission's recommendation and voted on January <br />22, 2002 to approve the applications. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to <br />GP 02-001, LP 01-014 and RZ 01-005: <br /> <br />1. The subject site is zoned B-4, Downtown Business and R-1A, Single Family Residential <br />before rezoning. <br /> <br />2. The City Council finds that requirements were met to rezone 745, 755, and 763 Old <br />Highway 8 NW and 748, 754, 766, and 784 4th Avenue NW to B-4, Downtown Business. <br /> <br />3. The applicant has drafted a "General Development Plan" which shall be the regulatory <br />force to control development on the site. <br /> <br />BE IT FURTHER RESOLVED, that based upon the above [mdings of fact the application GP 02-001, LP <br />01-014 and RZ 01-00S is hereby recommended for approval subject to the following conditions: <br /> <br />1. The applicant shall adhere strictly to the restrictions detailed on the General Development Plan. <br />2.
