<br />! : <br /> <br />.J, <br /> <br />RESOLUTION NO. 02-008 <br /> <br />8T ATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY BY EMINENT <br />DOMAIN <br /> <br />i <br />I <br />I <br />[ <br />WHEREAS, the City of New Brighton is a municipal corporation organized and! <br />I <br />operating under Minnesota law, and is authorized by Minnesota Statutes Sections 412.211 andl <br />465.01 to acquire private property for an authorized public purpose, using the procedure, <br />prescribed by Minnesota Statutes, Chapter 117; and . <br /> <br />WHEREAS, the City has identified the need to acquire fee simple title to certain real! <br />properties located in the City of New Brighton and legally described on the attached Exhibit Ai <br />(the "Properties") for purposes of future construction of a police facility; and ! <br /> <br />I <br />WHEREAS, the City staff has been unable to obtain a negotiated agreement with the! <br />owners of the Properties. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ne~ <br />Brighton: <br /> <br />1. The City Council makes the following findings of fact: <br /> <br />a. The current public safety facilities are inadequate to accommodate th~ <br />future needs of the City, and it is necessary and desirable that the Cit~ <br />construct a new public safety facility. ' <br /> <br />b. A citizen task force has studied several alternative locations for a ne~ <br />public safety facility, taking into account many factors, including but not <br />limited to impacts upon emergency response times, administrative <br />convenience and efficiency, community impacts, and cost. <br /> <br />c. Based upon the recommendation of the task force and its owrl <br />consideration of the matter, the City Council has identified the area <br />located between Fourth and Fifth Avenues NW and Seventh and Eighth. <br />Streets NW as the preferred location for the future police facility. Thlt <br />City Council has previously authorized staff to proceed to acquire tht <br />properties located within that area. i <br /> <br />1 <br />
