RESOLUTION NO. <br />10-023 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN AND SPECIAL USE PERMIT. <br />✓HE As, an application has been made by McDonald's USA LLC to permit reconstruction of <br />the isting McDonald's restaurant located at 721 Long Lake Road, and <br />✓HE4AS, the procedural history of the application is as follows: <br />1. pplications for a Site Plan and Special Use Permit were received on February 26, 2010. <br />2. notice for public hearing was posed in the March 3, 2010 edition of the New Brighton <br />3. lblic hearing notices were mailed to the property owners within 350' of the subject property <br />March 3, 2010. <br />4. ie Planning Commission held a public hearing on March 16, 2010 and all present were <br />ven a chance to freely speak at the hearing. <br />5. ie Planning Commission recommended approval on March 16, 2010, subject to conditions. <br />6. e City Council considered the request on March 23, 2010. <br />(HEAs, the Planning Commission and City Council make the following Findings of Fact with <br />resp t to the Site Plan (LP2010-001) and Special Use Permit (SP2010-002): <br />1. a property is zoned B — 3, General Business. <br />2. e property is guided in the Comprehensive Plan for Community Business. <br />3. a Planning Commission and City Council considered the Site Plan in accordance with the <br />— 3 district standards of Section 5-250, the commercial performance standards of Section <br />390, and the parking standards of Chapter 11 of the Zoning Code. <br />4. a Planning Commission and City Council found all applicable Site Plan standards to be <br />Planning Commission and City Council reviewed the proposed drive-thru in accordance <br />i the following standards: <br />The drive-thru facility does not negatively impact traffic on public rights-of-way. <br />A stacking lane shall be provided with a minimum of four spaces per lane in addition to <br />the number of required parking spaces. <br />The stacking lane shall be a minimum of twelve feet wide. <br />The vehicle stacking lane shall not extend beyond the street right-of-way line. <br />The vehicle stacking lane shall be delineated so that vehicles waiting in line will not <br />unreasonably interfere with the primary driving, entrance, exit, and parking facilities on <br />site. Employee -only designated parking may be considered in an effort to comply with <br />this condition. <br />Any pedestrian walkway that is adjacent to or crosses the stacking lane must be marked <br />and clearly indicated with signage or painted crosswalk. <br />The drive-thru use may be limited so as not to unreasonably interfere with adjacent and <br />SP2010-002 (McDonald's) - RESOLUDION.doc 1 <br />
