<br />" <br /> <br />.fl/' <br /> <br />i 1 <br /> <br />":!I <br /> <br />~ <br /> <br />RESOLUTION No. 99 - 0 12 <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF A SUBDIVISION OF CERTAIN PROPERTY <br />WITHIN THE CITY OF NEW BRIGHTON (BETWEEN LONG LAKE ROAD AND 12TH A VENUE). <br /> <br />WHEREAS, the City of New Brighton has been requested to subdivide certain property in the City <br />of New Brighton described as follows: <br /> <br />See Attached Exhibit "A" <br /> <br />WHEREAS, State Statutes require that if such property is located in municipalities that <br />have adopted a platting ordinance, approval of the municipality must be obtained before such <br />subdivisions can be filed; and <br /> <br />WHEREAS, Section 26-24 of the New Brighton City Code provides for subdivision of <br />property without platting if certain criteria can be met. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a minor subdivision was filed with the City of New Brighton on January <br />26, 1999. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on February 16, 1999, and all persons present at the hearing were given an opportunity to <br />be heard. The Planning Commission considered the minor subdivision and unanimously <br />recommended approval subject to conditions. (Vote: 5-0) <br />3. On February 23, 1999, the City Council considered the proposed minor subdivision; and <br /> <br />NoW, THEREFORE BE IT RESOLVED, the City Council of the City of New Brighton hereby <br />approves the subdivision of the above-described property into parcels described as follows: <br /> <br />See Attached Exhibit "B" <br /> <br />BE IT FURTHER RESOLVED, the City Council of the City of New Brighton approves PL-249, <br />subject to the following conditions: <br /> <br />1. A grading and drainage plan must be submitted with a building permit application to ensure <br />that any grading associated with the construction of the two homes shall not have anynegative <br />impacts on adjacent properties. <br />2. Per Section 26-27 of the New Brighton City Code, the applicant will be required to dedicate <br />$750 per lot (2 new lots) for park purposes. <br />
