RESOLUTION NO. 11-008 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. 7HE14As, an application has been made by Donald Wyland & Carol Noren on behalf of Pets Re"mbered to permit operation of a pet cremation business at the existing building located at 833 I° ST SW, Suite #2, and 7"AS, the procedural history of the application is as follows: 1. A�n application for a Special Use Permit was received on December 28, 2010. 2. I'he Planning Commission, pursuant to published and mailed notices, held a public hearing d January 18, 2011 and all present were given a chance to freely speak at the hearing. 3. 'ie Planning Commission voted to recommend approval on January 18, 2011 subject to 4. Oe City Council considered the request on January 25, 2011. ✓REAS, the Planning Commission and City Council make the following Findings of Fact with respt to the Special Use Permit (SP201 1 -001): 1. e property is zoned I-1, Light Industrial. 2. )$e property is guided in the Comprehensive Plan for Light Industrial. 3. a applicant has proposed to operate a pet cremation business, including the sale of ciliary pet cremation/memorial merchandise. 4. 2ie ning Code Section 6-050(2) allows approval of any use through Special Use Permit within I-1, Light Industrial, so long as the use is neither residential nor deemed heavy. 5. Planning Commission and City Council reviewed the proposal in accordance with the llowing Special Use Permit conditions of Zoning Code Section 8-130: j That the establishment, maintenance, or operations of the special use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare. That the special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood. That the establishment of the special use will not impede the normal and orderly I development and improvement of the surrounding property for uses permitted in the district. That adequate utilities, access roads, drainage and/or necessary facilities have been or are being provided. That the special use shall in all other respects conform to the applicable regulations of the district in which it is located. 6. lite Planning Commission and City Council found all Special Use Permit criteria of Section j130 to be met due to the following: `Adequate parking will be provided on site.
