RESOLUTION NO. 11-008 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />7HE14As, an application has been made by Donald Wyland & Carol Noren on behalf of Pets <br />Re"mbered to permit operation of a pet cremation business at the existing building located at <br />833 I° ST SW, Suite #2, and <br />7"AS, the procedural history of the application is as follows: <br />1. A�n application for a Special Use Permit was received on December 28, 2010. <br />2. I'he Planning Commission, pursuant to published and mailed notices, held a public hearing <br />d January 18, 2011 and all present were given a chance to freely speak at the hearing. <br />3. 'ie Planning Commission voted to recommend approval on January 18, 2011 subject to <br />4. Oe City Council considered the request on January 25, 2011. <br />✓REAS, the Planning Commission and City Council make the following Findings of Fact with <br />respt to the Special Use Permit (SP201 1 -001): <br />1. e property is zoned I-1, Light Industrial. <br />2. )$e property is guided in the Comprehensive Plan for Light Industrial. <br />3. a applicant has proposed to operate a pet cremation business, including the sale of <br />ciliary pet cremation/memorial merchandise. <br />4. 2ie <br />ning Code Section 6-050(2) allows approval of any use through Special Use Permit within <br />I-1, Light Industrial, so long as the use is neither residential nor deemed heavy. <br />5. Planning Commission and City Council reviewed the proposal in accordance with the <br />llowing Special Use Permit conditions of Zoning Code Section 8-130: <br />j That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />I development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />6. lite Planning Commission and City Council found all Special Use Permit criteria of Section <br />j130 to be met due to the following: <br />`Adequate parking will be provided on site. <br />The cremation will be on pets only and be conducted one at a time and by appointment <br />1 only. <br />PCommunity DevelopmenH-25-201 I\SP2011-001 (Wyland & No=) - RESOLUTION.doc <br />
