RESOLUTION No. 11-013 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLjUITION MAKING FINDINGS OF FACT AND APPROVAL OF A PRELIMINARY AND FINAL PLAT. WHERT AS, an application has been made by Finn Daniels Architects on behalf of The Stuart Company to be considered for a Preliminary and Final Plat for property located within the Northwwest Quadrant on the west side of Old Highway 8 NW, currently known as Outlot B, L0146 LAKE LANDING and Lot 1, Block 1, LONG LAKE LANDING, and WHEOAS, the procedural history of the application is as follows: P.i An application for a Preliminary and Final Plat was received by Finn Daniels Architects on behalf of The Stuart Company on December 3, 2010. �. Public hearing notices for the Preliminary and Final Plat were published in the New Brighton Bulletin December 8, 2010. .j Public hearing notification was distributed to all property owners within 600' of the subject property on December 10, 2010. �.� The Planning Commission, pursuant to published and mailed notices, held on a public hearing on December 21, 2010. �.I The Planning Commission recommended approval to the City Council for the Preliminary and Final Plat on December 21, 2010. i 8; The City Council considered the request on January 11, 2011 and January25, 2011. s, the Planning Commission and City Council make the following Findings of Fact with to the Preliminary Plat (PL2010-001) and Final Plat (FP2010-001): The property is zoned NWQ, Northwest Quadrant. The property is located in the area known as Tract 1 of the Northwest Quadrant, exclusively on the west side of Old Highway 8 NW, known as Block H and previously platted as LONG LAKE LANDING. The existing legal descriptions of the properties included in the preliminary and final plat requests are Outlots A, B, & C, LONG LAKE LANDING and Lot 1, Block 1, LONG LAKE LANDING. The proposed legal descriptions of the properties included in the preliminary and final plat requests are Outlots A & B, THE VIEW APARTMENTS AT LONG LAKE and Lot 1, Block 1, THE VIEW APARTMENTS AT LONG LAKE. The Planning Commission held a public hearing on the preliminary and final plat on December 21, 2010 and all persons were given the opportunity to be heard. Section 26-33 of the City Code provides the following qualifications governing approval of a preliminary plat: A. The Planning Commission may return a conditional recommendation. The City Council may require revisions as it deems necessary for the health, safety, general welfare, order and convenience of the City.
