<br />i <br />~ <br />I <br /> <br />l\ <br /> <br />..; <br /> <br />~ <br /> <br />RESOLUTION No. 00 - 025 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF SPOO-3. <br /> <br />WHEREAS, an application for a special use permit has been made by Independent School District <br />#621 and the City of New Brighton to construct an addition to Pike Lake Elementary School, and <br />expandlreconfigure the parking lot for Freedom Park. Per Section 4-030 of the New Brighton Zoning , <br />Ordinance, schools are a use allowed by special permit; and <br /> <br />WHEREAS, the procedural history ofthe application is as follows: <br />1. An application for a special use permit was filed with the City of New Brighton on March l, <br />2000. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on March 21, 2000, and all persons present at the hearing were given an opportunity to be <br />heard. The Planning Commission unanimously recommended approval ofSPOO-3, subject <br />to conditions. <br />3. On March 28, 2000, the City Council considered the proposed special use permit; and <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to SPOO.3: <br />I. The subject site is zoned R-l, Single Family Residential. <br />2. The proposed additions consist of a new entryway/administrative office (950 s.f.), two new <br />classrooms (1,975 s.f.), and a new mechanical room (975 s.f.). <br />3. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall <br />be recommended by the Planning Commission unless such shall find: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general public. ' <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish <br />and impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement ofthe surrounding property for uses permitted in the <br />district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or <br />are being provided. <br />e. That the special use shall, in all other respects, conform to the applicable regulations <br />of the district in which it located. <br />4. The proposed uses have been found to meet the above criteria. <br />5. The reconfigured parking area will include a "drop-off' cul.de-sac with a sidewalk leading <br />into the building, and additional parking spaces. This reconfiguration will create a safe area' <br />for parents to drop off and pick up their children. <br /> <br />BE IT FURTHER RESOLVED, that based upon the above findings of fact the application SPOO-3 is <br />hereby approved subject to the following conditions: <br /> <br />1 .
