<br />.1;.. <br /> <br />.. <br /> <br />RESOLUTION No. 96-92 <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ApPROVING NC-l 06. <br /> <br />WHEREAS, an application for a nonconforming use permit has been made by Hypro Corporation. <br /> <br />WHEREAS, the procedural history ofthe application for a nonconforming use permit is as follows: <br />1. An application for a nonconforming use permit was filed with the City of New Brighton <br />on September 27, 1996. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on October 15, 1996, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The City Council considered NC-106 at it's October 22, 1996 meeting. <br /> <br />Now, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to NC-1 06: <br /> <br />1. The subject site is zoned 1-2, Heavy Industrial. <br />2. The following Type IV nonconformity exists on the subject site: <br />a. The existing parking lot does not have concrete curbing. <br />3. The applicant proposes to reduce the nonconformity on the subject site by making the <br />following improvement: <br />a. Provide concrete curbing around the proposed addition. The remainder ofthe <br />parking lot is improved with bituminous curbing. <br />4. The applicant has reduced the number of Type IV nonconformities on the subject site to <br />the greatest practical extent. <br /> <br />BE IT FURTHER RESOLVED, the application NC-l 06 is hereby approved, subject to the following <br />condition: <br /> <br />1.
