<br />~...... <br /> <br />I' <br />il,; <br /> <br />" <br /> <br />.. <br /> <br />REsOLUTION No. 96 - 01 7 <br /> <br />STATE OF MiNNESOTA <br />COUNTY Of RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL USE PERMIT APPLICA nON SP-191. <br /> <br />WHEREAS, an application for a special use permit has been made by Mounds View Public Schools District <br />No. 621 (Sunnyside School); and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a special use permit, SP-191, was filed with the City of New Brighton on <br />March 1, 1996. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />March 19, 1996, and all persons present at the hearing were given an opportunity to be heard. <br />3. The City Council considered SP-191 at its March 26, 1996, meeting. <br /> <br />Now THEREFORE BE ITREsOL VED, the City Council makes the following Findings of Fact in respect to SP- <br />191: <br /> <br />I. The subject site is zoned R-l, Single Family Residential. <br />2. A school is a special use in an R-l district. <br />3. Sunnyside Elementary School is presently occupying the site. <br />4. Any expansion or enlargement to the structure or operation of a special use requires the approval <br />of a special use permit. <br />5. A 7,225 square foot addition is proposed for Sunnyside Elementary School for classroom <br />purposes. <br />6. The establishment, maintenance or operations of the special use will not be detrimental to or <br />endanger the public health, safety, morals, comfort, or general welfare. <br />7. The special use will not be injurious to the use and enjoyment of other property in the immediate <br />vicinity for the purposes already permitted, nor substantially diminish and impair property values <br />within the neighborhood. <br />8. The establishment of the special use will not impede the normal and orderly development and <br />improvement of the surrounding property for uses permitted in the district. <br />9. Adequate utilities, access roads, drainage and/or necessary facilities have been or are being <br />provided. <br />10. The special use shall in all otherrespects, conform to the applicable regulations ofthe district in <br />which it is located. <br /> <br />BE IT FURTHER RESOLVED, the application SP-191 is hereby approved subject to the following <br />conditions: <br /> <br />1. Conformance and adherence to all standards for special use permits as pertains Section 8-110 and <br />8-130 of the New Brighton Building Code.. <br />2.
