~...... I' il,; " .. REsOLUTION No. 96 - 01 7 STATE OF MiNNESOTA COUNTY Of RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL USE PERMIT APPLICA nON SP-191. WHEREAS, an application for a special use permit has been made by Mounds View Public Schools District No. 621 (Sunnyside School); and WHEREAS, the procedural history of the application is as follows: 1. An application for a special use permit, SP-191, was filed with the City of New Brighton on March 1, 1996. 2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on March 19, 1996, and all persons present at the hearing were given an opportunity to be heard. 3. The City Council considered SP-191 at its March 26, 1996, meeting. Now THEREFORE BE ITREsOL VED, the City Council makes the following Findings of Fact in respect to SP- 191: I. The subject site is zoned R-l, Single Family Residential. 2. A school is a special use in an R-l district. 3. Sunnyside Elementary School is presently occupying the site. 4. Any expansion or enlargement to the structure or operation of a special use requires the approval of a special use permit. 5. A 7,225 square foot addition is proposed for Sunnyside Elementary School for classroom purposes. 6. The establishment, maintenance or operations of the special use will not be detrimental to or endanger the public health, safety, morals, comfort, or general welfare. 7. The special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood. 8. The establishment of the special use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district. 9. Adequate utilities, access roads, drainage and/or necessary facilities have been or are being provided. 10. The special use shall in all otherrespects, conform to the applicable regulations ofthe district in which it is located. BE IT FURTHER RESOLVED, the application SP-191 is hereby approved subject to the following conditions: 1. Conformance and adherence to all standards for special use permits as pertains Section 8-110 and 8-130 of the New Brighton Building Code.. 2. Approval of LP-309. Adopted this 26th day of March, 1996.
