<br />RESOLUTION No. 95- 023 <br /> <br />i <br />I <br />, I <br />I <br />I <br />i <br />I <br />I <br />i <br /> <br />I <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF SPECIAL USE PERMIT <br />SP-186. <br /> <br />WHEREAS, an application for a special use permit has been made by NE Congregation <br />of Jehovah's Witnesses. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1 . An application for a special use permit was filed with the City of New Brighton <br />on February 3, 1995. <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />pUblic hearing on February 21, 1995, and on March 21, 1995, and all persons <br />present at the hearing were given an opportunity to be heard. <br />3. The City Council considered SP-186 on March 28, 1995. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact <br />, in respect to SP-186: <br /> <br />1. The subject site is zoned B-3, General Business. <br />2. The operation of a church in a B-3 district is a special use. <br />3. The NE Congregation of Jehovah's Witnesses are proposing to construct a 4,850 <br />square foot church in a B-3 district. <br />4. The proposed church building and related site improvements would comply with <br />the B-3 district and parking standards. <br />5. The church would hold four services per week each averaging 85 persons per <br />service. <br />6. The proposed site plan would allow for one access point to the subject site from <br />Silver Lake Road. Said access point would allow for only right-in and right-out <br />turns. <br />7. The proposed church development would be located on the most northerly end of <br />a commercial district and would be located adjacent to multi-family residential <br />developments. The proposed use would not be interrupting this strip of <br />commercial uses, but would instead serve to buffer a portion of the existing <br />multi-family residential uses from the commercial district. <br />8. The proposed church would compliment existing residential or commercial uses <br />and would not impede the normal and orderly improvement of surrounding <br />property. <br />9. According to the City's Comprehensive Plan, the surrounding neighborhood is <br />adequately served by the existing commercial uses at County Road E and Silver <br />Lake Road. "Vacant commercially zoned land along Silver Lake Road is proposed <br />for development at the general business level but further expansion of the <br />commercial area is not encouraged. Neighborhood need for convenience <br />commercial development has been largely satisfied by existing development. <br />General business services available in the larger area are generally judged <br />adequate by residents and additional commercial development is not considered <br />necessary.
