<br />RESOLUTION NO. <br />06-009 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING NC05-06 and LP05-12: <br /> <br />WHEREAS, an application has been made by Charles Schatz, DJR Architecture to be <br />considered for a Type 4 Non-confonning Use Pennit and Site Plan review to construct 52 <br />garages at 2090-2160 County Road E. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />I. An application for a type 4 non-confonning use penn its and site plan review was - <br />filed with the City of New Brighton on December 2,2005. <br /> <br />2. On December 20, 2005, the Planning Commission held a public hearing and all <br />present were given an opportunity to be heard. <br /> <br />WHEREAS, the City Council makes the following Findings of Fact in respect to <br />NC05.06 and LP05-12: <br /> <br />I.The subject site is zoned R-3A, Multi-Family Residential. <br /> <br />2. The proposed use is allowed in the R-3A zoning district. <br /> <br />3. The future use for the site is High Density Residential; and the proposed use is <br />consistent with New Brighton Comprehensive Plan. <br /> <br />4.The applicant is requesting a Type 4 Non-confonning Use Permit to construct 4 <br />detached garage structures. <br />5.A Type 4 Non-conforming use permit is required for the City to review the site plan. <br /> <br />6.Where Type 4 nonconformities are present and are proposed to continue, expansion of <br />the existing structure, construction of new structures, or resumption of use after <br />discontinuance of use for six or more months shall be allowed only upon permission of <br />the City Council <br />7.As specified in Section 8-460 (2) of the New Brighton Zoning Ordinance, no Type 4 <br />Nonconfonning Use Permit shall be granted unless one or more of the following <br />conditions are met: <br />a. The total number of nonconformities is reduced. <br />b. The impact of any nonconfonnities upon adjacent premises is reduced to the <br />greatest practical extent. <br />c. The extent of any nonconfonnity is reduced where practical. <br /> <br />8.The Planning Commission held a public hearing on December 20, 2005 and reviewed <br />the application and recommended approval to the City Council. <br />9. The City Council reviewed the application and finds that the applicant meets the <br />conditions of Section 8-460. <br />
