1.

RESOLUTION NO.94-011

STATE OF MINNESOTA
COUNTY OF RAMSEY
CITY OF NEW BRIGHTON

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-295.

WHEREAS, an application for a variance has been made by Industrial Equities, Inc.; and

WHEREAS, the procedural history of the application is as follows:

1. An application for a variance was filed with the City of New Brighton on December 3,
1993.
2. The Planning Commission, pursuant to published and mailed notices, held a public
hearing on December 21, 1993, and all persons present at the hearing were given an
opportunity to be heard.
3. The City Council considered VN-295 on January 11, 1994.

NOW, THEREFORE, BE IT RESOLVED the Planning Commission makes the following Findings
of Fact in respect to VN-295:

1. The subject property is zoned 1-1, Light Industrial.
2. The required street sideyard setback in an 1-1 district is 40 feet or 20 feet by
permission of the City Council.
3. The City Council reduced the street sideyard setback to 20 feet for the subject site
on September 28, 1993, when LP-282 was approved.
4. The applicant is requesting a 5 foot street sideyard setback variance to construct a
proposed off-street parking Jot 15 feet from the Lakeview Point street right-of-way.
5. The 150 foot setback from Jones Lake reduced the amount of buildable area in the
Lakeview Business Campus plat and reduced the width of the subject lot.
6. To comply with the requirements of the American Disabilities Act (ADA), a 10 foot
strip of sidewalk and green area is designated in front of the proposed building. This
strip forced the off-street parking area 5 feet closer to the Lakeview Point right-of-
way.
7. Lakeview Point is a cul-de-sac and not a through street serving the subject site and
the U.S. West site to the north.
8. The proposed variance would not have a negative impact on surrounding land uses or
alter the character of the area.
9. The applicant has demonstrated unique and unusual circumstances and an undue
hardship pertaining to the variance request.

BE IT FURTHER RESOLVED, the application VN-295 is hereby approved.

Adopted this 11th day of January, 1994.

~~aYo<
1'11#(f~/ ,8 (Jeki-

Manhew S.
