. 4 \) l'l RESOLUTION NO. 94-004 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF A PORTION OF OLD HIGHWAY 8. WHEREAS, the procedural history of the application is as follows: 1. The City Council, pursuant to published notices, held a public hearing on September 14, 1993, and all persons were given an opportunity to be heard. 2. The written comments of the City Staff were considered. 3. The legal description in Resolution 93-110 was found to be in error and a corrected legal description is provided below. WHEREAS, the request is to vacate a part of Old Highway 8 described as: That part of the right-of-way of Old State Trunk Highway No.8 within the south 210.00 feet of the north 675.00 feet of the Northwest Quarter of the Southwest Quarter of Section 16, Township 30 North, Range 23 West, Ramsey County, Minnesota lying east of a line 49.50 feet east of the center line of said highway. And That part of the right-of-way of Old State Trunk Highway No.8 lying east of a line 49.50 feet east of the center line of said highway, lying west of the west line of blocks 1 and 2 and vacated Center Avenue in the plat of Mounds Center, lying south of the westerly extension of the north line of Lot 7 of said Block 1 and lying north of the westerly extension of the south line of Lot 1 2 of said Block 2. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New Brighton makes the following Findings of Fact in respect to the proposed vacation: 1 . The road easement to be vacated is unimproved and does not serve a public purpose. 2. There are no utilities within the road easement. BE IT FURTHER RESOLVED, that the vacation of the Old Highway 8 right-of-way as described above is hereby approved.
