<br />"- <br /> <br />11 <br /> <br />i <br />" <br />,I <br /> <br />RESOLUTION NO. 91. 0 2 5 <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A SPECIAL USE PERMIT: <br />SP-l 61 . <br /> <br />WHEREAS, an application for a special use permit, SP.161, has been made by Atonement Lutheran Church <br />to allow a church addition and a day care facility in an R.3A district. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a special use permit, SP.181, was filed with the City of New Brighton on March 1, <br />1991. <br />2. The Planning Commission, pursuant to published and mailed notices, held a publiC hearing on March <br />19, 1991, and all persons present at the hearing were given an opportunity to be heard. <br />3. The City Council considered the application for SP.1 61 on March 26, 1 991. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to <br />Sp.1 61 : <br />1. The subject site is zoned, R-3A, Multiple Family Residential. <br />2. A church and a day care are special uses in the R.3A district. <br />3. Atonement Lutheran Church is presently occupying the subject site. <br />4. Any expansion or enlargement to the structure or operation of special use requires the approval of a <br />special use permit. <br />5. A 3,500 square foot addition is proposed for Atonement Lutheran Church which would include a <br />worship center, nursery, library, and reception area. <br />6. The Atonement Lutheran Church has over 5,000 square feet of nonresidential building area, over 1 <br />acre of lot area, and over 50 parking stalls, and therefore, according to Section 4-030 (f) of the <br />Zoning Ordinance may operate a licensed day care facility in the church as a special use. <br />7. The proposed church addition and day care facility border an office building, apartment building, and <br />two publiC streets, thereby not abutting a single family residential lot or dwelling. <br />8. That the establishment, maintenance or operations of the special use will not be detrimental to or <br />endanger the public health, safety, morals, comfort or general welfare. <br />9. That the special use will not be injurious to the use and enjoyment of other property in the immediate <br />vicinity for the purposes already permitted, nor substantially diminish and impair property values <br />within the neighborhood. <br />10. That the establishment of the special use will not impede the normal and orderly development and <br />improvement of the surrounding property for uses permitted in the district. <br />11. That adequate utilities, access roads, drainage and/or necessary facilities have been or are being <br />provided. <br />12. That the special use shall in all other respects, conform to the applicable regulations of the district in <br />which it is located. <br /> <br />BE IT FURTHER RESOLVED, the application SP.161 is hereby approved subject to the following <br />conditions: <br />1. Conformance and adherence to all standards for special use permits as pertains in Section 8-110 and <br />8-130 of the New Brighton Building Code. <br />2.
