<br />~ <br /> <br /> <br />,~ <br /> <br />.. <br /> <br />RESOLUTION NO. 89- 69 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />,RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, <br />VN-274. <br /> <br />WHEREAS, an application fo1' a variance has been made by Interstate <br />,Centre Development Company, Ine.,; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a~,'ariance was filed with the City of New <br />Brighton on March 31. 1989. <br />2. The Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on April 18, 1989, and all <br />persons present at the hearing were given an opportunity to <br />be heard. <br />3. The application for VN-274 was reviewed by the City Council <br />on April 25, 1989. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the <br />~following Findings of Fact in respect to VN-274: <br /> <br />1. The subject site is zoned 1-2, Heavy Industrial. <br />2. The required front yard setback for off-street parking in an <br />I -2 district is 40 feet, <br />3. The requested seven;'oot setback variance would allow a <br />portion of the proposed off-street parking area to be located <br />33 feet from the County Road D right-of-way. <br />4. The County acquired seven additional feet of right-of-way <br />along a portion of the south (front) property line of the <br />subject site to allow for the construction of a right turn lane <br />on County Road D. <br />5. An existing eight inch sanitary sewer pipe bisects the subject <br />site, thereby, preventing the proposed building and off-street <br />parking area from being setback the required 40 feet from the <br />County Road D right-of-way. <br />6. The proposed landscape plan would allow for a berm and <br />plantings to be install(:.~d along the County Road D boulevard <br />to soften the impact of the reduced setback area. <br />7. The applicant has demonstrated unique and unusual <br />circumstances and an undue hardship. <br /> <br />BE IT FURTHER RESOLVED, the application for VN-274 is hereby' <br />: ~pproved subject to the following conditions: <br /> <br />1.
