'

~~

.~ i
~'I
I
I
1 ~
I
I

RESOLU:ION NO. 89-~

STATE OF MINNESOTA
COUNTY OF RAMSEY
CITY OF NEW BRIGHTON

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR
PLANNED UNIT DEVELOPMENT, PUD-4.

WHEREAS, an application for a Planned Unit Development entitled PUD-4
has been made by Opus Corporation.

WHEREAS, the procedural history of the application is as follows:

1. An application for Planned Unit Development PUD-4 was filed with
the City of New Brighton on March 24, 1989.

2. Such application was reviewed by the New Brighton Planning
Commission on April 4, 1989.

3. The City Council, pUrS(lant to published and mailed notices, held
a public hearing on April 11, 1989 and on April 25, 1989, and
all persons present were given an opportunity to be heard.

NOW THEREFORE BE IT RESOLVED, the New Brighton City Council makes
the following Findings of Fact ~n respect to PUD-4:

1. The subject site is approximately 4.3 acres in size and is
located generally south of 1-694 and north of 10th Street NW.

2. The subject site is presently vacant and zoned B-3, General
Business.

3. The adjacent properties to the south are zoned R-3B, Multiple
Family, the property to the east is zoned R-3A, Multiple Family,
and the subject site is bounded by 1-694 right-of-way to the
west and north.

4. The New Brighton Compf?hensive Plan designates the subject site
for General Business.

5. The proposed development would consist of a three-story office
building comprised of 72,000 square feet of floor area.

6. The proposed development would establish a landscape screen
along the east property line, adjacent to the R-3B residential
district, consisting of 34 spruce trees and a four foot high
berm.

7. The proposed development would be consistent with the adopted
Comprehensive Plan of the City.

8. The proposed development would be designed to form a desirable
and unified environment within its own boundaries in terms of
visual character, patterns of circulation, and sufficiency of
drainage and utilities,

9. The proposed developme~t would be compatible with present and
planned uses in the su~round area.

10. The exception to the B'-3 district height requirement allowing a
three-story structure to be constructed on the subject site
would be justified by the large setbacks, effective landscape
screening proposed, and general design of the development.

11. The burden or impact created by the proposed development on
parks, schools, street~, and other public facilities would be
minimal.
