<br /> <br />, II <br /> <br />11.1 <br />I, <br /> <br />RESOLUTION No. <br />06-044 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />LUTION MAKING FINDINGS OF FACT AND RECOMMENDING ApPROVAL of SP 2006- <br /> <br />REAS, an application for a Special Use Permit hasbeen made by Patrick MacKenzie <br />and Atonement Lutheran Church to permit food preparation by a third party <br />within the church's commercial kitchen for distribution off site, and <br /> <br />REAS, the procedural history of the application is as follows: <br /> <br /> <br />An application for a Special Use Permit was received on Apri128, 2006. <br /> <br />A Public hearing notice for the Special Use Pennit was published in the New <br />Brighton Bulletin on May 3, 2006. <br /> <br />Public hearing notification was distributed to all property owners within 350' of <br />the subject property. <br /> <br />The Planning Commission, pursuant to published and mailed notices, held on a <br />public hearing on May 16, 2006. <br /> <br />The Planning Commission recommended approval to the City Council for the <br />Special Use Permit on May 16,2006. <br /> <br />The City Council reviewed the request on May 23,2006. <br /> <br />W EREAS, the City Council makes the following Findings of Fact in respect to SP 2006w <br />00 <br />1. The subject site is zoned R-3A, Multi-Family Residential District. <br />2. The applicant is requesting a Special Use Pennit to allow food preparation by <br />a third party for distribution off-site in accordance with the following <br />conditions noted within Section 4-030 (1) (A): <br />a. Preparation of food, with proper facilities and licenses to be <br />approved by the City Sanitarian, shall be the sole aspect of the <br />business. <br />b. Overnight parking of vehicles or any outside storage of materials <br />associated with the business is prohibited. <br />c. Exterior signage is prohibited. <br />d. Number of employees associated with the use shall be limited to <br />two (2). <br />e. Hours of operation shall not negatively impact surrounding <br />residential uses. <br />
