, II 11.1 I, RESOLUTION No. 06-044 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON LUTION MAKING FINDINGS OF FACT AND RECOMMENDING ApPROVAL of SP 2006- REAS, an application for a Special Use Permit hasbeen made by Patrick MacKenzie and Atonement Lutheran Church to permit food preparation by a third party within the church's commercial kitchen for distribution off site, and REAS, the procedural history of the application is as follows: An application for a Special Use Permit was received on Apri128, 2006. A Public hearing notice for the Special Use Pennit was published in the New Brighton Bulletin on May 3, 2006. Public hearing notification was distributed to all property owners within 350' of the subject property. The Planning Commission, pursuant to published and mailed notices, held on a public hearing on May 16, 2006. The Planning Commission recommended approval to the City Council for the Special Use Permit on May 16,2006. The City Council reviewed the request on May 23,2006. W EREAS, the City Council makes the following Findings of Fact in respect to SP 2006w 00 1. The subject site is zoned R-3A, Multi-Family Residential District. 2. The applicant is requesting a Special Use Pennit to allow food preparation by a third party for distribution off-site in accordance with the following conditions noted within Section 4-030 (1) (A): a. Preparation of food, with proper facilities and licenses to be approved by the City Sanitarian, shall be the sole aspect of the business. b. Overnight parking of vehicles or any outside storage of materials associated with the business is prohibited. c. Exterior signage is prohibited. d. Number of employees associated with the use shall be limited to two (2). e. Hours of operation shall not negatively impact surrounding residential uses.
