RESOLUTION NO. 89-~ STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON " '\ RESOLUTION APPROVING SUBDIVISION OF CERTAIN PROPERTY WITHIN THE CITY OF NEW BRIGHTON (generally 390-360 Cleveland Avenue SE). WHEREAS, the City of New Brighton has been requested to subdivide certain property in the City of New Brighton as follows: The South one hundred (S 100) feet of the North three hundred eighty-three (N 383) feet lying East of Trunk Highway No. 35W, Lot One (I), AUDITOR'S SUBDIVISION NO. 26, according to the recorded plat thereof on file and of record in the office of the Registrar of Deeds of Ramsey County, Minnesota. The S 250 feet of the N 283 feet of the E 250 feet of Lot 1, AUDITOR'S SUBDIVISION NO. 26, Ramsey County, Minnesota, lying easterly of Trunk Highway 394. The South 10.00 acres of the Southeast quarter of the Northeast quarter of Section 32, Township 30, Range 23, lying easterly of State Trunk Highway 394. WHEREAS, State Statutes require that if such property is located in municipalities that have adopted a platting ordinance, approval of that municipality must be obtained before such subdivisions can be filed, and WHEREAS, Section 26-24 of the New Brighton City Code provides for subdivision of property without platting if certain criteria can be met; and WHEREAS, the City Council has determined that such criteria has been met. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of New Brighton that the Council approves subdivision of the above described property into parcels described as follows: PARCEL A The north 300.00 feet of that part of the south 10.00 acres of the Southeast quarter of the Northeast quarter of Section 32, Township 30, Range 23, Ramsey County, Minnesota, lying easterly of State Trunk Highway 394, subject; to Cleveland Avenue SE over the easterly 33 feet thereof. PARCEL B That part of the south 10.00 acres of the Southeast quarter of the Northeast quarter of Section 32, Township 30, Range 23, Ramsey County, Minnesota, lying southerly of the north 300.00 feet thereof, and easterly of State Trunk Highway 394, subject to Cleveland Avenue SE, over the easterly 33 feet thereof, and The north 383.00 feet of Lot 1, AUDITOR'S SUBDIVISION NO. 26, on file and of record in the office of the County Recorder of Ramsey County, Minnesota, lying easterly of State Trunk Highway 396, subject to Cleveland Avenue SE over the easterly 33 feet thereof; Subject to the following condition: 1.
