<br />., .. <br /> <br />r.r ~.,. <br /> <br />RESOLUTION NO. 88--1.iL <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL <br />USE PERMIT APPLICATION SP-156. <br /> <br />WHEREAS, an application for a special use permit has been made by <br />i the applicant, Tony Mazzenga. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. That an application for a Special Use Permit, SP-156, was - <br />filed with the City of New Brighton on December 2, 1988. <br />2. The Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on December 20, 1988, and all <br />persons present at the hearing were given an opportunity to be <br />heard. <br />3. On December 27, 1988, the City Council reviewed the application <br />for SP-156. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton Planning <br />Commission makes the following Findings of Fact in respect to SP-156: <br />1. The subject site is zoned R-l, Single Family Residential. <br />2. Moving a single family home onto a lot in an R-l district <br />requires special use permit approval. <br />3. The proposed single family home would comply with the <br />requirements of the Uniform Building Code prior to being <br />occupied. <br />4. The proposed single family home would comply with the R-1 <br />district setbacks and FAR. <br />5. The establishment, maintenance or operations of the special use <br />will not be detrimental to or endanger the public health, safety, <br />morals, comfort or general welfare. <br />6. The special use will not be injurious to the use and enjoyment <br />of other property in the immediate vicinity for the purposes <br />already permitted, nor substantially diminish and impair property <br />values within the neighborhood. <br />7. The establishment of the special use will not impede the normal <br />and orderly development and improvement of the surrounding <br />property for uses permitted in the district. <br />8. Adequate utilities, access roads, drainage and/or necessary <br />facilities have been or are being provided. <br />9. The special use shall in all other respects, conform to the <br />applicable regulations of the district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, that the application for SP-156 is and <br />hereby approved subject to the following conditions: <br />1. Conformance and adherence to all standards for special use <br />permits as pertains in Section 8-110 and 8-130 of the New <br />Brighton Building Code. <br />2. A driveway turnaround be provided alongside the proposed <br />driveway to avoid having vehicles back onto County Road H. <br />3.
