<br />~ -.... ~ <br /> <br />RESOLUTION NO. 88--1~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A SPECIAL <br />USE PERMIT SP-155. <br /> <br />WHEREAS, an application for a Special Use permit, SP-155 has been made <br />by the City of New Brighton to allow an outdoor volleyball court in a B-4 <br />district. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for Special Use permit, SP-155 was filed with the <br />City of Np.w Brighton on September 30, 1988. <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on October 18, 1988, and all persons present <br />at the hearing were given an opportunity to be heard. <br />3. On October 25, 1988, the City Council reviewed an application for <br />SP-155. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to SP-155: <br />1. The subject site is zoned B-4, Downtown Business. <br />2. Recreational facilities operated in conjunction with a business are <br />a Special Use in the B-4 district. <br />3. The New Brighton Municipal Liquor Store (Powerhouse Bar) is <br />presently occupying the ~ubject site. <br />4. An outdoor volleyball court and patio area is proposed for the site <br />area immediately north of the liquor store. <br />5. The outdoor volleyball court would be encompassed by netting to <br />restrict activities to the court. <br />6. The patio area and court area would be screened with a decorative <br />fence and landscaping to reduce the impact of said use and separate <br />patrons from 5th Avenue NW. <br />7. All outdoor lighting for the volleyball court and patio would be <br />turned off at 10:00 p.m. <br />8. That the establishment, maintenance or operations of the special use <br />will not be detrimental to or endanger the public health, safety, <br />morals, comfort or general welfare. <br />9. That the special use will not be injurious to the use and enjoyment, <br />of other property in the -immediate vicinity for the purposes alreadyl <br />permitted, nor substantially diminish and impair prooerty values i <br />within the neighborhood. <br />1Q. That the establishment of the special use will not impede the normal <br />and orderly development and improvement of the surrounding property <br />for uses permitted in the district. <br />11. That adequate utilities, access roads, drainage and/or necessary <br />fafilities have been or are being provided. <br />12.
