<br />~ <br /> <br />" <br /> <br />RESOLUTION NO. 88-1268 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />,I <br /> <br />· RF-SOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />,APPLICATION SP-153. <br /> <br />WHEREAS, an application for a Special Use permit has been made by the <br />,i applicants, Ted Becchetti and Rick Roth. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />:1 <br /> <br />1. An application for Special Use permit, SP-153 was filed with the <br />City of New Brighton on September 30, 1988. <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on October 18, 1988, and all persons present <br />at the hearing were given an opportunity to be heard. <br />3. On October 25, 1988, the City Council reviewed application SP-153. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />i. Fi ndi ngs of Fact in respect to SP-153: <br /> <br />1. <br />2. <br />i <br />3. <br />4. <br />5. <br />6. <br />7. <br /> <br />The subject site is zoned R-3, Multiple Family Residential. <br />Moving an apartment building onto a lot in an R-3B district requires <br />Special Use permit approval. <br />The proposed apartment building would comply with the requirements <br />of the Uniform Building Code prior to being occupied. <br />The proposed development will have a minimal impact on surrounding <br />land uses. <br />The site is separated from the single family homes to the northwest <br />by an elevated railroad right-of-way. <br />The establishment, maintenance or operations of the special use will <br />not be detrimental to or endanger the public health, safety, morals, <br />comfort or general welfare. <br />The special use will not be injurious to the use and enjoyment of <br />other property in the immediate vicinity for the purposes already <br />permitted. nor substantially diminish and impair property values <br />within the neighborhood. <br />8. The establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for <br />uses permitted in the district. <br />9. Adequate utilities, access roads, drainage and/or necessa~y <br />facilities have been or are being provided. <br />10. The special use shall in all other respects, conform to the <br />applicable regulations of the district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, the application for SP-153 is hereby approved <br />subject to the following conditions: <br /> <br />1. Conformance and adherence to all standards for Special Use permits <br />as pertains in Section 8-110 and 8-130 of the New Brighton Building <br />Code. <br />2. Approval of VN-268. <br />3. Approval of LP-234. <br />4.
