<br />" <br />I <br /> <br />,.,1 <br /> <br />RESOLUTION NO. 88-~A <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-268. <br /> <br />WHEREAS, an ~pplication for a variance has been made by Ted Becchetti <br />and Rick Roth for a building and parking setback variance for property <br />located generally north of Foss Road, west of the Lakeview Mobile Home Park, <br />. and south of the SOD Line Railroad right-of-way, <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for variance was filed with the City of New Brighton <br />on September 30, 1988. <br />2. The Planning r.ommission, pursuant to published and mailed notices, <br />held a public hearing on October 18, 1988, and all persons present <br />at the hearing were given an opportunity to be heard, <br />3. On October 25, 1988, the City Council reviewed application VN-268. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to VN-268: <br /> <br />1. The property is zoned R-3B, Multiple Family Residential. <br /> <br />2. The required building setback from an R-1 lot line is 30 feet. <br /> <br />3. Code requires 15 feet of landscaping from and R-l lot line, which <br />creates a de facto parking setback. <br /> <br />4. The applicant has requested'a 20 foot building setback variance and <br />a 10 foot parking setback variance from the northwest (R-1) lot <br />line. <br /> <br />5. There is a 100 foot wide elevated railroad right-of-way abutting the <br />northwest lot line which serves to buffer the subject site from the <br />single family homes in the nearby R-l district. <br /> <br />6, The applicant has demonstrated a unique and unusual circumstance in <br />that the lot is triangular in shape, which makes meeting setback <br />requirements difficult. <br /> <br />7. Granting the variance will not adversely impact the single family <br />homes in the nearby R-1 district because of the buffering effect <br />created by the elevated railroad right-of-way. <br /> <br />BE IT FURTHER RESOLVED, the application for VN-268 is hereby approved <br />subject to the following conditions: <br /> <br />1. Approval of LP-234. <br />2. Approval of SP-153. <br /> <br />3.
