"~ RESOLUTION NO. 88-~ STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION APPROVING THE VACATION OF THE PORTION OF 2ND STREET NW RIGHT-OF- WAY LOCATED ON LOT 4, BLOCK 1, BRIGHTON CORPORATE PARK. WHEREAS, the City Council has been requested to vacate the portion of 2nd Street NW right-of-way on Lot 4, Block 1, Brighton Corporate Park. WHEREAS, the procedural history of the vacation proceedings is as follows: 1. The requested vacation of the above described street right-of-way was initiated on July 1, 1988. 2. The City Council, pursuant to published notice, held a public hearing on July 12, 1988, to consider the vacation. All persons present at the hearing were given an opportunity to be heard. NOW THEREFORE BE IT RESOLVED, by the New Brighton City Council following Findings of Fact are made in respect to the proposed vacation: 1. Approval of the final plat for Brighton Corporate Park was conditioned on the portion of 2nd Street NW right-of-way located on Lot 4, Block 1, Brighton Corporate Park being vacated. 2. The existing utilities within the subject right-of-way would be disconnected and removed during the grading process for Brighton Corporate Park. 3. Acquisition of title and possession of all adjacent properties will have occurred by August 26, 1988. 4. On and after August 27, 1988, this portion of 2nd Street NW would serve no public purpose. BE IT FURTHER RESOLVED, that the following described 2nd Street NW right-at-way is hereby vacated effective August 27, 1988: 1. That part of the highway eaSement for Cleveland Avenue described in Document Number 734462, Ramsey County Recorder lying west at "Line 1" and lying east of "Line 3". "Line 1" is described as beginning at the point of intersection of the northerly right-at-way line of the Soo Line Railroad Company with a line run parallel with and distant 200 teet westerly of "Line 2" described below; thence run northerly to a point distant 168 feet westerly (measured at right angles) of a i point on said "Line 2" distant 261.86 feet southerly of its point of termination; thence run northerly to a point distant 200 feet westerly (measured at right angles) from the point of termination of said "Line 2" and there terminating. "Line 2" is described as beginning at a point on the south line of Section 29, Township 30, Range 23, Ramsey County, Minnesota distant 198 feet west of the southeast corner thereat; thence run northeasterly at an angle of 84 degrees 45 minutes 30 seconds trom said south section line (measured from east to north) for 962.33 feet; thence deflect to the right on a 0 degree 30 minutes 00 seconds curve (delta angle 2 degrees 10 minutes 00 seconds" for 433.33 teet and there terminating. "Line 3" is a line drawn north, parallel with the east line of the Southeast Quarter of Southeast Quarter of said Section 29, from a point on the north right-of-way line of first Street North, plat of NEW BRIGHTON distant 889.7 feet west of said east line of Southeast Quarter of Southeast Quarter, as measured along said north right-ot-way line and its easterly extension.
