<br />" <br /> <br />.... ....._ .!h, <br /> <br />RESOLUTION NO. 88---1b- <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION APPROVING THE VACATION OF THE PORTION OF 2ND STREET NW RIGHT-OF- <br />WAY LO~~TED ON LOT 4, BLOCK 1, BRIGHTON CORPORATE PARK. <br /> <br />" WHEREAS, the City Council has been requested to vacate the portion of <br />!i2nd Street NW right-or-way on Lot 4, Block 1, Brighton Corporate Park. <br /> <br />" <br />;1 <br /> <br />WHEREAS, the procedural history of the vacation proceedings is as <br />follows: <br /> <br />1. The requested vacation of the above described street right-of-way <br />was initiated on July 1, 1988. <br /> <br />2. The City Council, pursuant to published notice, held a public <br />hearing on July 12, 1988, to consider the vacation. All persons <br />present at the hearing were given an opportunity to be heard. <br /> <br />NOW THEREFORE BE IT RESOLVED, by the New Brighton City Council following <br />Findings of Fact are made in respect to the proposed vacation: <br /> <br />1. Approval of the final plat for Brighton Corporate Park was <br />conditioned on the portion of 2nd Street NW right-of-way located on <br />Let 4, Block 1, Brighton Corporate Park being vacated. <br /> <br />2. The existing utilities within the subject right-of-way would be <br />disconnected and removed during the grading process for Brighton <br />corporate Park. <br /> <br />'! <br /> <br />3. The existing residential properties adjacent to the subject right- <br />of-way have been purchased by the City except for 346 - 2nd Street <br />NW. <br /> <br />4. The City has a purchase agreement for 346 - 2nd Avenue NW and is <br />scheduled to close on said property on July 15, 1988. <br /> <br />5. Once all the residential properties adjacent to the subject right- <br />of-way have been purchased, this portion of 2nd Street NW would <br />serve no public pUI"Fose. <br /> <br />BE IT FURTHER RESOLVED, that the following described 2nd Street NW <br />right-of-way is hereby vacated: <br /> <br />" <br />'1 <br /> <br />1. That part of the highway easement for Cleveland Avenue <br />described in Document Number 734462, Ramsey County Recorder <br />lying west of "Line 1" and lying east of "Line 3". <br /> <br />::( <br /> <br />.; <br />i: <br /> <br />"Line 1" is described as beginning at the point of intersection <br />of the northerly right-of-way line of the Soo Line Railroad <br />Company with a line run parallel with and distant 200 feet <br />westerly of "Line 2" described below; thence run northerly to a <br />point distant 168 feet westerly (measured at right angles) of a <br />point on said "Line 2" distant 261. 86 feet southerly of its <br />point of termination; thence run northerly to a point distant <br />200 feet westerly (measured at right angles) from the point of <br />termination of said "Line 2" and there terminating. <br /> <br />" <br />1, <br />H <br />I <br />,I <br /> <br />, ~ <br /> <br />j; <br /> <br />'I <br /> <br />"Line 2" is described as beginning at a point on the south line <br />of Section 29, Township 30, Range 23, Ramsey County, Minnesota <br />distant 198 feet west of the southeast corner thereof; thence <br />run northeasterly at an angle of 84 degrees 45 minutes 30 <br />seconds from said south section line (measured from east to <br />north) for 962.33 feet; thence deflect to the right on a 0 <br />degree 30 minutes 00 seconds curve (delta angle 2 degrees 10 <br />minutes 00 seconds" for 433.33 feet and there terminating. <br /> <br />i <br />" <br /> <br />"Line 3" is a line drawn north, parallel with the east line of <br />the Southeast Quarter of Southeast Quarter of said Section 29, <br />from a point on the north right-of-way line of First Street <br />North, plat of NEW BRIGHTON distant 889.7 feet west of said east <br /> <br />" <br />q <br /> <br />ii <br />
