" .... ....._ .!h, RESOLUTION NO. 88---1b- STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION APPROVING THE VACATION OF THE PORTION OF 2ND STREET NW RIGHT-OF- WAY LO~~TED ON LOT 4, BLOCK 1, BRIGHTON CORPORATE PARK. " WHEREAS, the City Council has been requested to vacate the portion of !i2nd Street NW right-or-way on Lot 4, Block 1, Brighton Corporate Park. " ;1 WHEREAS, the procedural history of the vacation proceedings is as follows: 1. The requested vacation of the above described street right-of-way was initiated on July 1, 1988. 2. The City Council, pursuant to published notice, held a public hearing on July 12, 1988, to consider the vacation. All persons present at the hearing were given an opportunity to be heard. NOW THEREFORE BE IT RESOLVED, by the New Brighton City Council following Findings of Fact are made in respect to the proposed vacation: 1. Approval of the final plat for Brighton Corporate Park was conditioned on the portion of 2nd Street NW right-of-way located on Let 4, Block 1, Brighton Corporate Park being vacated. 2. The existing utilities within the subject right-of-way would be disconnected and removed during the grading process for Brighton corporate Park. '! 3. The existing residential properties adjacent to the subject right- of-way have been purchased by the City except for 346 - 2nd Street NW. 4. The City has a purchase agreement for 346 - 2nd Avenue NW and is scheduled to close on said property on July 15, 1988. 5. Once all the residential properties adjacent to the subject right- of-way have been purchased, this portion of 2nd Street NW would serve no public pUI"Fose. BE IT FURTHER RESOLVED, that the following described 2nd Street NW right-of-way is hereby vacated: " '1 1. That part of the highway easement for Cleveland Avenue described in Document Number 734462, Ramsey County Recorder lying west of "Line 1" and lying east of "Line 3". ::( .; i: "Line 1" is described as beginning at the point of intersection of the northerly right-of-way line of the Soo Line Railroad Company with a line run parallel with and distant 200 feet westerly of "Line 2" described below; thence run northerly to a point distant 168 feet westerly (measured at right angles) of a point on said "Line 2" distant 261. 86 feet southerly of its point of termination; thence run northerly to a point distant 200 feet westerly (measured at right angles) from the point of termination of said "Line 2" and there terminating.
