<br />.. <br /> <br />; <br /> <br />RESOLUTION NO. 88-12 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PL-167 (Bent Tree Hills). <br /> <br />WHEREAS, an application for preliminary plat approval has been made by <br />Harstad Companies, Inc.; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for preliminary plat approval was filed with the City <br />of New Brighton on January 4, 1988. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on January 19, 1988 and all persons present at <br />the hearing were given an opportunity to be heard. <br /> <br />3. The preliminary plat PL-167 was reviewed by the City Council on <br />January 26, 1988. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to PL-167: <br /> <br />1. That the property is zoned R-1, single family residential and R-2, <br />two family residential. <br /> <br />2. That the area of the plat is 34.5 acres. <br /> <br />3. That the preliminary plat meets the subdivision requirements of <br />Chapter 26 of the City Code, and the standards of the R-1 and R-2 <br />districts. <br /> <br />BE IT FURTHER RESOLVED, the application PL-167 is hereby approved <br />subject to the following conditions: <br /> <br />1. That all proposed structures for the proposed Bent Tree Hills plat <br />conform to the R-1 zoning district setbacks. <br /> <br />2. That all driveways be located a minimum of five feet from the <br />property line. <br /> <br />3. Permit approval by the Rice Creek Watershed District. <br /> <br />4. A concept development plan be found acceptable by the City for the <br />undeveloped portion of the subject site to the south, prior to <br />approving any further subdivisions of property on or adjacent to the <br />subject site. <br /> <br />5. Erosion control measures be applied by the applicant along 12th <br />Street NW during the construction period. <br /> <br />6.
