<br />1 <br /> <br />, ':d <br /> <br />RESOLUTION NO. 86-131 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVING VN-250 (generally <br />located south of Mississippi Street NW and west of 27th Avenue <br />NW). <br /> <br />WHEREAS, an application for a street sideyard setback variance <br />has been made by William Barbush, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. That an application for VN-250 was filed with the City of New <br />Brighton on October 27, 1986. <br /> <br />2. That the Planning Commission, pursuant to published and mailed <br />notices, held a pUblic hearing on November 18, 1986, all persons <br />at the hearing were given an opportunity to be heard. <br /> <br />3. That application PL-150 was reviewed by the City Council <br />on November 25, 1986. <br /> <br />4. The written cOOlllents and analysis of the city staff, the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />BE IT FURTHER RESOLVED by the City Council that the following <br />Findings of Fact are made In respect to VN-250. <br /> <br />1. That the property is zoned R-2, Two-family Residential. <br /> <br />2. That the required street sldeyard setback for a corner lot in the <br />R-2 district is 30 feet pursuant to Section 4-240 (c) of the <br />Zoning Code. <br /> <br />3. That the applicant is requesting a 15 foot street sideyard <br />setback. <br /> <br />4. That the subject site is part of the approved PRD-27. <br /> <br />5. That the 15 foot street sideyard setback complies with the intent <br />of PRO-27 when approved prior to August 21, 1981. <br /> <br />6. That PRD-27 was approved prior to changing the sideyard setbacks <br />to 30 feet. <br /> <br />7. That Lot 8 would require a 15 foot street sideyard setback <br />variance In order to be buildable. <br /> <br />8. That a 15 foot street sideyard setback variance was granted for <br />Lot 9. Block 2. Park Place, which abuts Lot 8 to the south. <br /> <br />BE IT FURTHER RESOLVED that the application VN-250 Is and hereby <br />approved subject to the fOllowing conditions: <br /> <br />1.
