<br />I <br /> <br />I <br /> <br />I <br /> <br />COUNCIL PROCEEDINGS <br /> <br />CITY OF NEW BRIGHTON <br /> <br />Pursuant to notice thereof, an emergency special meeting of the New Brighton City Council was held Thursday, <br />October 5, 1995, at 11:45 a.m. at the New Brighton Family Service Center, 400 - 10th Street NW. <br /> <br />Present: <br /> <br />Mayor Benke, CounciImembers Larson and Samuelson. <br /> <br />Absent: <br /> <br />Councilmember Gunderman and Williams <br /> <br />Also Present: <br /> <br />Matthew Fulton, City Manager <br />Charlie LeFevere, City Attorney <br />Erny Mattila, City Planner <br />Tom Hauk <br />Gary Hauk <br /> <br />Council Business <br /> <br />City Attorney Charlie LeFevere provided the Council an explanation of the Statutory <br />guidelines as it pertains to the declaration and request of an emergency City Council <br />meeting indicating that City Councils can declare an emergency meeting when a <br />situation arises that requires immediate attention in order to avoid a negative impact <br />on the public health, welfare, and safety. He further indicated that statutory <br />requirements provide for the necessity to notify all affected parties in good faith <br />including media sources that have requested such information in writing. LeFevere <br />indicated that he had talked to two different attorneys representing the interests <br />involved with this matter before the emergency Council; and in fact, the principles <br />involved with this issue are present at the meeting. <br /> <br />After calling the meeting to order, Mayor Benke requested City Planner Erny Mattila <br />to provide a background of the situation. Mattila described the time line as to the <br />processing of the requested sign permit as well as provided an overview regarding the <br />historical actions taken by the Council with regard to this parcel. <br /> <br />Mattila presented the request to adopt a Moratorium Ordinance and Resolution on <br />billboards located closer than 200 feet to a residential property line. In June 1993, <br />Council approved the rezoning of the subject site from R-2, two family residential, to <br />B-1, Limited Business, and approved a site plan for a 4,500 sq. ft. office building <br />proposed by Wooddale Builders. Throughout the process, residents living adjacent to <br />the site expressed concern, however, those concerns were put to rest when W ooddale <br />proposed a residential looking structure which would blend in with adjacent <br />properties. <br /> <br />Wooddale has now decided not to build on the site and offered it for sale to Mr. Tom <br />Hauk who owns a transit sign business. Hauk wishes to construct a billboard on the <br />site and would like to eventually locate his business there also. However, since no <br />billboard can be located within 150 ft. of a structure, placing a billboard on the site <br />would render the site unbuildable. Hauk would be forced to purchase the residential <br />lot next door and attach it to the site if he wanted to place his business at this location. <br /> <br />Council rezoned the site with the intent of an office building construction. The <br />placement of the billboard on this site was not the anticipated use of the site when it <br />was rezoned.
