<br />,. <br /> <br />~ <br /> <br /><. <br /> <br />.of <br /> <br />.Ii <br /> <br />RESOLUTION NO. 85-140 <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION DENYING A SPECIAL USE <br />PERMIT FOR WASTE ENERGY SYSTEMS, INC. <br /> <br />WHEREAS, Waste Energy Systems, Inc. (applicant) has request- <br />ed a special use permit (SUP) to construct and operate a mass <br />burn waste to energy plant at the northeast intersection of 1st <br />Avenue N.E. and 14th Street (the property); and <br /> <br />WHEREAS, the plant will be used to incinerate unprocessed <br />solid waste; and <br /> <br />WHEREAS, all of the solid waste which will be incinerated at <br />the plant will be generated in Hennepin or Anoka County; and <br /> <br />WHEREAS, the property is zoned 1-1, Light Industry; and <br /> <br />WHEREAS, a mass burn waste to energy plant is not among the <br />uses permitted as of right in the I-I zone by section 6-030 of <br />the New Brighton Zoning Code; and <br /> <br />WHEREAS, the City of New Brighton (the City) may grant an <br />SUP for such a use within the I-I district only if the use meets <br />the standards specified in section 8-130 of the New Brighton <br />Zoning Code, which standards are as follows: <br /> <br />(a) That the establishment, maintenance or operations of <br />the special use will not be detrimental to or endanger <br />the public health, safety, morals, comfort or general <br />welfare; <br /> <br />(b) That the special use will not be injurious to the use <br />and enjoyment of other property in the immediate <br />vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values <br />within the neighborhood; <br /> <br />(c) That the establishment of the special use will not <br />impede the normal and orderly development and improve- <br />ment of the surrounding property for uses permitted in <br />the district; <br /> <br />(d) That adequate utilities, access roads, drainage and/or <br />necessary facilities have been or are being provided; <br />and <br /> <br />(e) That the special use shall, in all other respects, <br />conform to the applicable regulations of the district <br />in which it is located; and <br />
