BETWEEN 12TH AVENUE N.W. <br />, ; AND COUNTY ROAD II E". <br /> <br />! WHEREAS, the City Council has been peti tioned to vacate 1st Street <br />"N.W. between 12th Avenue N.W. and County Road "E"; and <br /> <br />WHEREAS, the procedural history of the vacation proceedings is as <br /> <br />fo 11 ows : <br /> <br />'!I <br /> <br />1. That the adjacent property owner who comprises 50% of the adjacent <br />owners, requested the vacation of 1st Street N.W. between 12th <br />Avenue and County Road "E", <br /> <br />2. That the City Council pursuant to published notice held a Public <br />Hearing on December 10, 1985, to consider the vacation. All <br />person's present were given an opportunity to be heard. <br /> <br />3. The written comments and analysis of the City Staff, and all <br />person's statements made at the public hearing were considered. <br /> <br />WHEREAS, the request is to vacate a portion of 12th Avenue N.W. <br />!: des cri bed as follows: <br /> <br />i' <br />:;That part of 1st Street N.W. lying easterly of the East right of way line of <br /><12th Avenue N.W. and lying northerly and westerly of the following described <br />,'1 i ne: <br /> <br />. Commencing at the Southwester corner of said North Half of She South !~ <br />iHalf of the Southeast Quarter of the Southwest Quarter; thence N 89 57' 26'1 E, <br />ibearing assumed'oalong the South line of said North Quarter, a distance of 513.0 <br />ifeet; thence N 6 46' 34" W, a distance of 33.23 feet to the North right of way i <br />Iline of said 1st StreBt N.W. and the point of beginning of the line to be ! <br />described; ~hence S 6 46' 34" E, a distance of 33.23 feet to said South line; ! <br />; thence S 89 57' 26" E, along said South line, a distance of 172,63 feet; thencel <br />; Southwesterly, along a non-tangentia6 curve concave to the South having a radius I <br />lof 432.56 feet, a centrel angle of 8 17' 45", an arc length of 62.63 feet and I <br />a chord bearing of S 58 07' 50" W to thEl South right of way line of said 1st , <br />Street N.W. and there terminating. I <br />I <br />WHEREAS, upon vacation of the above described public right-of-way, I <br />!public interest in the property will accrue to the following described abutting I <br />:properties: I <br /> <br />Belair Park Plat No.9; and ; <br />I <br />The North 119.55 feet of that part Northwesterly of the Centerline I <br />of County Road E of the Wes t 530.68 feet the Sou th *, s ubj ect to roadsl' <br />in Section 29, Township 30, Range 23, New Brighton, Minnesota (PIN I <br />Number 29-30-23-34-0065).
