i 1- - t,' ~..,.... RESOLUTION NO. 85-122 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF NC-74 (Clinch-On-Corners). WHEREAS, an application for a non-conforming use permit has been made by Ted Haines of Clinch-an-Corners; and WHEREAS, the procedural history of the application is as follows: 1. That an application for a non-conforming use permit was filed with the City on September 30, 1985. 2. That the Planning Commission, pursuant to published and mailed notices, held a public hearing on October 15, 1985, all person's present at the hearing were given an opportunity to be heard. 3. That the application for a non-conforming use permit was reviewed by the City Council on October 22, 1985 and that the comments and analysis of Staff and the Planning Commission minutes and recommendations were considered. NOW THEREFORE BE IT RESOLVED by the City Council that the following Findings of Fact are made in respect to NC-74: 1. That there exists only one Type IV Non-conformity on the site, i.e. a 5.9 side yard building setback. 2. That it would be undue hardship to require a 15 foot side yard building setback. 3. That the applicant has done everything practical to address the site non-conformities since the app1icant1s first approved non-conforming use permit in 1977. BE IT FURTHER RESOLVED that the appl ication NC -74 is and hereby recommended for approval subject to the following conditions: 1. That one handicapped parking stall be designated as re- quired by City Code. 2. That all parking stalls be striped to bring order to the on-site parking. 3. That the curbing along the entrance drive be painted yellow to show that parking is not allowed. Adopted this 22nd day of October, 1985. ATTEST: Manager ~\..-'""" A.
