<br />WHEREAS an appeal of the Staff decision to not permit the
<br />operations of a farmers market has been made by Raymond Nathe and
<br />St. John's Church.
<br />
<br />~~HEREAS the procedural history of the applic ation is as follml/s:
<br />
<br />1. That the City Council considered the appeal made by
<br />Raymond Nathe and St. John's Church on September 24, 1985.
<br />2. That the written comments and analysis of Staff was
<br />considered.
<br />3. That the applicant appealing the Staff findings was given
<br />the opportunity to be heard and present testimony.
<br />
<br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City i
<br />:'Council makes the following Findings of Fact in respect to an I
<br />appeal of the City Staff's decision to not permit the ~perations o~
<br />a farmers market in an R-l zoning:
<br />
<br />1. That the Church of St. John the Baptist is zoned
<br />R-l, single family residential.
<br />2. That a farmers market is not a permitted use in a
<br />R-l, single family residential zoning per sections
<br />4-010 thru 4-030 of the New Brighton zoning code.
<br />3. That a farmers market is not listed as a permitted
<br />use in any section of the New Brighton zoning code except
<br />that under Section 5-010 (4) the City Council can consider
<br />other uses for a commercial zoning. if in the opinion of
<br />the Council, such use is not incompatible with other uses
<br />in the district.
<br />
<br />BE IT FURTHER RESOLVED, that the request to operate a farmers
<br />-market in a R-l, Single Family zoning district is hereby denied.
<br />
<br />Adopted this 24th day of September, 1985.
