<br />..." <br /> <br />- '" <br /> <br />RESOLUTION NO'~9 <br />STATE OF MINNESOTA <br />CO UN T Y 0 F R Ar~ S E Y <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND DENYING SP-124 FOR TOM <br />THUMB. <br /> <br />I. <br /> <br />WHEREAS, an application for a special use permit has been <br />i made by Tom Thumb Food Markets; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />!. <br /> <br />i <br />) ~ <br /> <br />1. That an application for a special use permit was <br />filed with the City on June 28, 1985. <br />2. That the Planning Commission, pursuant to published <br />and mailed notices, held a public hearing on July 16, <br />1985. all person's present at the hearing were given <br />an opportunity to be heard. <br />3. That the Public Hearing was continued at the request <br />of the Planning Commission to August 20. 1985. <br />4. That the application for a special use permit. SP-124. <br />was reviewed by the City Council on August 27. 1985, <br />and that the comments and analysis of Staff and the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />I following Findings of Fact are made in respect to SP-124. <br />I <br /> <br /> 1 . <br /> 2 . <br />" 3. <br /> 4. <br />,. <br /> 5 . <br /> <br />]! <br /> <br />That the property is zoned B-2, Neighborhood Business. <br />That the sale of gasoline in a B-2 zoning requires a <br />special use permit. <br />That the property is adjacent to an R-l. Single Family <br />Residential District. <br />That the proposal may be injurious to the enjoyment of <br />property in the vicinity, specifically the single family <br />homes because of the increase in outside activities, <br />outdoor lighting. noise, litter and a possible increase <br />in traffic. <br />The proposal would be detrimental to the general welfare <br />of the neighborhood in that it would create increased <br />outside activities, increased lighting, increased noise <br />and increased litter all of which are not compatible <br />with surrounding land uses. <br />6.
