<br />~I .. <br /> <br />il RESOLUTION NO. 85-65 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />I' CITY OF NEt-J BRIGHTON <br /> <br /> <br />RESOLUTION MAKING FINDINGS OF ACT AND APPROVING NC-72 <br /> <br />WHEREAS, an application for a nonconforming use permit has <br />been made by DeLaria Transport; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />. , <br />" <br /> <br />1. That an application for a nonconforming use permit <br />was filed with the City on June 3, 1985. <br />2. That the Planning Commission, pursuant to published <br />and mailed notices, held a public hearing on June 18, <br />1985, all person's present at the hearing were given <br />an opportunity to be heard. <br />3. That the application for a nonconforming use permit was <br />reviewed by the City Council on June 25,1985 and that <br />the comments and analysis of staff and the Planning <br />Commission minutes and recommendations were considered. <br /> <br />'I <br /> <br />l: <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to NC-72: <br />1. That the site is zoned 1-1, Light Industrial. <br />2. That the site has the following existing Type IV non- <br />conformities: <br />a. Lack of front yard landscaping. <br />b. Less than required front yard parking setback. <br />c. Lack of concrete curbing. <br />d. Lack of designated on-site parking. <br />e. Concrete Block facade on existing building. <br />f. Wider than permitted curb cut. <br />3. That the applicant will reduce the total number <br />of existing type IV nonconformities on the site <br />and reduce the extent of the existinq type IV <br />nonconformities to the extent practical by doing <br />the following: <br /> <br />a. Providing 22-feet of front yard landscaping. <br />b. Paving all front yard drive and parking areas. <br />c. Providing 12 designated on-site parking spaces. <br />d. Installing concrete curbing around all parking <br />and drive areas in the front yard setback. <br />e. Reducing the size of the driveway curb cut to <br />36 feet. <br /> <br />BE IT FURTHER RESOLVED that the application NC-72 is and <br />hereby approved subject to the following conditions: <br /> <br />1. That the existing building be repainted to match <br />the proposed new building. <br />2. That the signs on the existing building be removed <br />and replaced by a new sign on the new building. <br />3.
