<br />f.' <br /> <br />RESOLUTION NO. <br /> <br />85-61 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PRELIMINARY <br />PLAT PL-142 <br /> <br />WHEREAS, an application for preliminary plat approval has <br />been made by Rembrant Enterprises; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for preliminary plat was filed with <br />the City on June 3, 1985, <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a pUblic hearing on June 18, 1985, <br />all persons present at the hearing were given an <br />opportunity to be heard, and <br />3. That the application for preliminary plat approval was <br />reviewed by the City Council on June 25, 1985, and that <br />the comments and analysis of staff and the Planning <br />Commission minutes and recommendations were considered. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council that <br />the following Findings of Fact are made in respect to PL-142: <br /> <br />1. That the property is zoned R-l, Single Family, : <br />2. That the property is presently vacant with the exceptionl <br />of one single family home, and i <br />3. That the preliminary plat is consistent with the sub- <br />division regulations contained in Chapter 26 of the <br />New Brighton City Code. <br /> <br />BE IT FURTHER RESOLVED that the application PL-142 is and <br />hereby approved subject to the following conditions: <br /> <br />1. That all grading, drainage, utilities and street <br />names be subject to review and approval by the City <br />Engineer, <br />2 , T hat Lot 2 ha s' there qui red m i n i mum 7 5 f 0 0 t lot wid t h <br />at the building setback line, <br />3. That easements be drawn between Lots 5 and 6 and Lots <br />10 and II, <br />4. That the 25 foot rear yard setback line be eliminated, <br />5. That the utility easement between Lots 6 and 7 be 25 <br />feet wide and that the buildable width of Lots 6 and 7 <br />not be less than 50 feet, and <br />6. That the existing single family home within the site be <br />removed within 120 days of the final plat approval. <br /> <br />Adopted this 25th day of June, 1985. <br /> <br />~tfJ~ <br />Gregor.
